집 근처에서 작은 공사를 하고 있었습니다. 보통 45mph zone이라 그냥 35mph
정도 달리고 있었는데 갑자기 police가 앞에서 speed gun을 쏘고 있다가
저를 세웠습니다. 그리고는 speed gun을 보여주며 53mph으로 나온 radar gun을 보여주며 ticket을 끊었습니다.ticket내용에는 ‘cvc 22350 basic speed
law construction zone’이라고 적혀 있고 오늘 court에서 ticket bill이
날라왔습니다. 자그만치 325불이나 되네요.인터넷에서 자료를 찾아보니

아래내용

나는 이 ticket이 부당하다고 생각이 되는데,그 이유는

1.평소에 이 길을 다니며 speed limit이 45mph라는걸 잘 알고 있고 공사구간이라 lane이 하나로 좁아지는 상황에서 당연히 속도를 줄였기 때문에 경찰관이 보여준 device의 53mph라는 수치는 수긍하기 힘들다.

2.나는 경찰관이 과연 speed measuring device를 적절하게 사용했는지,또는
정확히 manual대로 사용했는지,또 당시 장비는 정상적인 작동을 했는지에 대해 의문을 가지고 있다.이는 이 ticket의 진실을 파악하는데 있어서 대단히
중요한 문제이고 그 자료와 증거를 보고자 한다.

3.이 구간 뿐만아니라 시내 어느곳에서도 50mph이상으로 절대 달리지 않는다.
왜냐하면 나의 차는 truck이고 나는 speed 내는걸 좋아하지 않는다.사진에서
보여지듯 특히 그 구간은 언덕길이라 더더욱 그 속도을 내기가 어렵다.
나의 driving record가 보여주듯 미국에서 9년동안 운전하며 단 한번도
speed ticket을 받은 기록이 없다.

4.그 당시 공사구간에서 25mph라는 speed limit을 보지 못했고 인근의 큰공사
가 행해지고 있는 xx road에서의 speed limit은 40mph이다. 운전자의 일반적
상식으로 이 구간 또한 40mph로 인지할 수 있었던 상황이었고, 나는 30~35
mph정도로 달리고 있었다.

문장이 많이 길어 졌네요. 하지만 이 내용이 앞으로 speed ticket을 받는
다른 분들이 참고할 수있는 자료가 될 수도 있겠다는 생각도 듭니다.

근데 찍힌 시간과 날짜가 일치하나요. 요즘 예산때문에 주차위반이나 교통티켓 범칙금으로 수입잡는다던데…

위상황에서 인정될수 있는것은 1번 정도가 될것같네요. 레이다에 걸렸다면 희망이 없어 보이네요.
님이 평소에 몇마일이상은 달리지 않는다는 주장에 대한 근거가 있나요? 그것 또한 님의 생각뿐 이번 티켓하고는 전형 연관이 없어 보이네요. 또한 사인을 보지 못했다는것은 님의 운전중 부주의를 인정하는것이니까 이런 말은 오히려 더 불리합니다.

엘에이 법원에 직접 가서 콘테스트 해본 경험이 있어 한말씀 올립니다.
재판 날에 경찰관이 스피드 건의 정확도를 측정한 calibration 기록을 가지고 옵니다. 정기적으로 검사하도록 되어 있다는군요. 이 기록을 가지고 오면 님이 무조건 집니다.
1, 2 번은 따질만한 사유가 됩니다. 3번은 소용 없습니다.
4번은 사진을 여러 장 찍어서 확실한 증거를 만들어 법정에 가져가야 합니다.

I think you should bring the reason 1 and 4. if you say something about #2, you will loose. They do not like somebody is confronting their authority.
You need to use very plain voice not adding your emotion.

I am driving this road everyday. So I know this road’s speed limit 45 mph and residential. I never drive more than 45 mph on this road.
That day, I did not see the notice for low speed limit, but i saw there was a construction going on. So I slowed down my speed to 35 mph. Then that police gave me a ticket and he mentioned that I drove 53 mph. I do not understand how he got this speed. Because to use laser is illegal. and also, the regulation of the speed, then you can mention the law.

I think my voice contains emotion also. So use your own language. delete this “Because to use laser is illegal. and also, the regulation of the speed, then you can mention the law. ” or explain as far as i know, to use laser detctor in this situatiol is illegal. …

오늘 우연히 직장 동료가 이런 경우을 이야기하더군요. 자기는 연기를 최대한 미룬답니다. 2-3번 연장한뒤에 기일에 가면 경찰이 결국은 잊어버리고 안온다는군요. 그러면 자기가 이긴다더군요. 그친구는 그런식으로 2번 speed ticket을 안냈다더군요. 그냥 전하는 이야기 입니다. 그 친구가 님이 언급하신 법규정에 대해 언급하더군요. 그럼 꼭 이기시길 빌며.

Can you estimate the distance between where the police were with the laser gun and where you stopped? If you were driving 53mph per police, you had to push the break harder than 35mph driving speed, and the car must stressed out, especially the condition of the road that you are describing. You could bring that up to convince judge also.
