SOCIAL SECURITY TAX AND MEDICARE TAX UPON STATUS CHANGE

    Hi, all,

    I have a question about refund of Social Security Tax and Medicare Tax withheld erroneously.

    I was working with F1 Visa type – International Student- from Feb. 11 to Jun. 27 2005. During that period, Social Security Tax and Medicare Tax were deducted from my wage though I didn’t have to pay those as a non-resident alien.

    However, my status has been changed as of Jun. 28 2005 to H1B, which means I have to file my annual tax return as a resident from this year.

    In this event, can I still file for refund of SS Tax and Medicare Tax?
    Any help would be greatly appreciated.

      Yes, you can. I have done it and got the money back. But before you file any form with IRS you should ask your employer (who withheld the money) to refund them.

      I have one more question. Could you let me know if you have an idea on this?
      Is it ok to file annual tax return preceeding over social and medicare tax return? I’m concerned about this because of status change.
      And, I talked about social security and medicare tax issue to my employer last Jul but they didn’t seem to work on this. Can I just file by myself?
      Referring to IRS website, I may need my employer’s help to get a kind of statement. So, basicailly, do I have to wait for my employer to figure this out first?
