DOL posted a a set of Questions and Answers on its Web site, regarding the impact of prevailing wage determination delays in the H-1B labor condition application (LCA) context. The FAQ reviews the use of non-NPWD alternative wage data, the absence of safe-harbor when using such sources.

Prevailing wage determinations. The Department of Labor informed NAFSA and other associations in a September 9, 2011 conference call that they hope to become current on court-ordered H-2B prevailing wage redeterminations by the week of September 19, and thereafter become current (i.e., be back to a 60-day processing period) on other prevailing wage determinations on the following timeline:
Newly filed H-2B: by mid October
PERM prevailing wage determinations: by the first week of November
H-1B prevailing wage determinations: by the second week of November
In the meantime, DOL has already begun working on the PERM prevailing wage determination backlog on a first-in first-out basis, with the oldest outstanding PERM determination request being the first week of June at the time of the conference call.
ACWIA SOC codes in iCERT. In the same call, DOL also announced that the issue with ACWIA SOC codes not appearing in the drop-down menus in the iCERT LCA application has been resolved, and that the codes should now appear in those menus.
