OPT를 받고 일하고 있는 분들의 경우 취업비자 신분으로 변경하는 경우가 많이 있다.

이러한 경우 발생되는 일을 좀 살펴보겠다.

실제적으로 OPT를 연장할 수 있는 경우는 STEM(SCIENCE, TECHNOLOGY, ENGINEERING, MATHEMATICS) 분야의 경우만 연장 가능하다.

하지만 중간 이러한 공백기간 때문에 발생되는 일을 막기 위해서 만들어진 것이 CAP-GAP EXTENSIONS 라는 것이 있다.

OPT 신분으로 취업비자 신청을 한후 승인인 된 경우 취업비자 시작지점인 10월 1일까지 신분 그리고 일할수 있는 신분까지 자동으로 연장이 된다는 것이다.

이 경우 빨리 해당 학교에 연락을 취해서 본인이 CAP-GAP EXTENSION에 해당한다는 사실을 알려야 합니다.

하지만 OPT 기간이 취업비자 신청시점인 4월 1일 이전에 끝나는 경우, 물론 GRACE PERIOD 60일 기간이 있기 때문에 이 기간에 취업비자 신청을 해서 승인을 받을 수 있다. 이 경우에는 체류신분이 일 시작시점인 10월 1일까지 연장이 되지만, EAD 기간이 만료가 된 상태에서 취업비자 신청을 해서 승인을 받은 것이기 때문에 일은 할 수가 없다.

Cap-Gap Extensions

A cap-gap extension is a regularly provision which automatically extends an eligible F-1 student’s status to bridge the gap between the end of F-1 status and start of H-1B status, thereby allowing the student to remain in the US during the “gap.” The cap-gap between is now available to students who, as of April 1st, 2011, were either on approved OPT or in their 60-day grace period and have a pending or approved change-of-status October 1, 2011 H-1B petition with the USCIS that was filed prior to the expiration of their OPT or 60-day grace period.

This cap-gap extension will produce one of two outcomes, depending on your individual situation:

1. Extension of your OPT work authorization to September 30th, 2011. This happens if your original OPT end date (on your EAD card) is on or after the day that your employer filed an approved H-1B petition. For Example: if your OPT end is April 15, 2011 and your employer files an approved H-1B petition on April 5, Your OPT is automatically extended.

2. Extension or your F-1 “Duration of status.” This happens if you are in your 60-day grace period on the day your approved H-1B petition is filed. Again, you would be allowed to stay in the US if you otherwise maintain your F-1 status, but you are not authorized to work until the H-1b petition is approved and goes in to effect October 1st, 2011.
