제가 자주 올때보다 훨씬 Traffic이 많아 졌네요..

영주권이후 해야할일중에서 자녀가 영주권을 받은후 14세가 되면 30일안에
I-90을 biometrics fee 80불(application fee 면제)과 함께 이민국에 file
해야 되는걸로 알고 그대로 했는데. 모든 서류들이 다 되돌아왔습니다.
그내용은(I-797C) 다음과 같습니다..

This is in reference to the Form I-90, Application to Replace Permanent Resident Card, you submitted. Your I-90, fees and a supporting documentation is being returned to you for the following reason:

The applicant marked”g”in Part2, Question 2, as the reason for filing the Form I-90. This reason requires the applicant to have reached their 14th birthday since their permanent resident card had been issued and the current card will expire before their 16th birthday. Furthermore, applicants must file the Form I-90, within 30 days of reaching their 14th birthday. Our record show the applicant either had not filed within 30 days of reaching his/her 14th birthday, or the current card expired after the applicant’s 16th birthday. You can resubmit the application with the appropriate fee as described on the USCIS internet page.

그런데 I-797C 의 Received Date이 July 01,2009 이고 Date of Birth 는 June 05, 1995 인데 왜 30일안에 I-90을 File 하지 않았다는건지 정말 알수가 없습니다.. 그래서 이 내용을 쓴 Letter를 첨부해 다시 이민국에 보냈는데 위와 같은 이유를 담은 I-797C과 모든서류들과 Check가 다시 돌아왔습니다..

혹시 저와 같은 경우를 경험하신분 계시면 답글좀 달아주세요.
그냥 안해도 된다는 분도 계시고..

저희 아이도 전에 그렇게 신청해서 새로운 영주권 카드를 받았습니다.

이민국의 편지를 읽어 보니, 그쪽에서 잘못 처리한 것 같습니다.

“This reason requires the applicant to have reached their 14th birthday since their permanent resident card had been issued and the current card will expire before their 16th birthday.”

I-90 설명서를 보면,
16세 이전에 카드가 만료되어야 한다는 말은 나오지 않고,
대신…
14번째 생일이후 30일 내에 영주권 카드를 갱신 신청을 할 때,
16번째 생일 이전에 영주권 카드가 만료되지 않으면
신청료 $290을 면제한다고 나옵니다.

제가 보기에는 이민국의 실수입니다.
왜 제대로 해주지 않은 것인지 모르겠군요.
