제 상황은,
EB-3, 학생신분으로 넣었고,7월 대란 때 동시파일. EAD card는 받았으나 쓰지않고 있다가 현재 exfired된 상태. 140 승인나면 쓰라고 해서 안쓰고 있었음.
PD는 2007, June. (2005년 실패했다가 다시함.)

1. Submit evidence to establish that the petitioner had the financial ability to pay the offered wage as of June 18, 2007, and continues to have such ability. USCIS notes that the petitioner sumitted a corporate tax return statement from 2006 and an individual tax statement from 2005. However, neither tax return statement established an ability to pay the proffered wage of $28,588. Evidence submitted to establish the petitioner’s ability to pay must include the petitioner’s annual report, U.S. taxreturn including all schedules and attachments, or audited financial statement in its entirety from 2007. The petitioner may also include additional evidence, such as the beneficiary’s W-2 Forms from the petitioner for 2007 and 2008 if is available.

2. Submit evidence that the beneficiary obtained the required 12 months of experience in the job offered before June 18, 2007. USCIS notes that a letter from Cultual Design OB2 was submitted as evidence of the beneficiary’s experience in the job offered. However, the letter the letter is insufficient to establish twelve months of full time experience. Evidence of experience must be in the form of letter(s) from current of former employer(s) giving the name, address, and title of the employer and a description of the experience of alien, including number of hours worked per week, specific dates of the employment, and specific duties.

3. The labor certification requires that the beneficiary have experience in “design using Microsoft FonyPage, Adobe Photoshop, Adobe illustrator, Adobe ImageReady, Flash, Micromedia Dream Weaver, Micromedia Fire Works, and WS FTP95 LE, among other software programs.” Submit evidence that the alien fulfilled the special requirements in item 14 of Section H of the labor certification before June 18, 2007.

1. 스폰서의 2007년 재정증명이 빠졌다는 말입니다. 혹은 원글님의 2007년, 2008년 W-2(반드시 스폰서로부터 받은것)으로 대신할수 있다는 말입니다.
2. 12개월 경력에 대한 증거가 부족하다는 말입니다.
3. LC에는 이러이러한 tool을 필요로 한다고 되어있는데 원글님의 background에는 그런 내용이 없다는 말입니다.

어떤 변호사가 일을 했는지 모르겠지만 저보다 못하군요.

그럼, 3번의 요구사항은 어떻게 증명할 수 있을까요? 2번의 요구사항, 즉, 경력증명서에다가 3번의 tool background 가 쓰여졌었다고 얘기하면 될까요? 어떤 증명을 보여줄 수 있는지요?
