My employer paid my H-1b filing and attorney fee plus $1,000 premium processing.
The total was $6,200. The thing is they put those figures on my W-2 as a gift and my gross income bumped up by $6,200, which never taxed on. I don’t know whether they have to put those numbers on my W-2 in order to claim as a legitimate business expense or not but I owe $2,000 to the US government based on my ’06 tax return.
Has anybody ever experienced this situation? Is there any way to reduce tax or waive the gift off from my W-2?
