2016 말에 H-1 승인 후 미국에 입국해 현재 H-1 B 마케팅 Analysis 로 도매상에서 3년째 근무하는 40대 남성입니다.
다음달 9월말일이 저희 H-1 비자 만료 기일인데요..저희 회사 담당 변호사가 H-1B 연장 서류접수 준비 중인데, 최근에 들리는 정보는 예전에는 비자가 접수되고, 서류심사 결과가 나올때까지 회사체크 받으면서 합법적 체류가 될수 있었는데, 최근에는 연장 서류 접수 여부와 상관없이 비자 만료가 되면 승인여부 나올때 까지 한국으로 일단 나가있어야 한다고 하는데, 사실 아이가 둘이나 있고, 가족이 한번 나갔다가 들어오는 게 보통일이 아닐뿐 더러 일년전 주택도 구입한 터라 저에게는 보통일이 아니네요.
그리고 최근에는 같은회사에 3년간 잘 근무했다고 하더라도, H-1B 비자연장이 어렵다고 하는데, 고수님들 의견 부탁 드립니다

일반적으로 H1B 신분 만기전 연장 신청을 하시면 체류 하시면서 결과를 받을때까지 근무를 계속하셔도 됩니다.
8 CFR § 274a.12(b)(9) – Classes of aliens authorized to accept employment.
(9) A temporary worker or trainee (H-1, H-2A, H-2B, or H-3), pursuant to § 214.2(h) of this chapter, or a nonimmigrant specialty occupation worker pursuant to section 101(a)(15)(H)(i)(b1) of the Act. An alien in this status may be employed only by the petitioner through whom the status was obtained. In the case of a professional H-2B athlete who is traded from one organization to another organization, employment authorization for the player will automatically continue for a period of 30 days after acquisition by the new organization, within which time the new organization is expected to file a new Form I-129 to petition for H-2B classification. If a new Form I-129 is not filed within 30 days, employment authorization will cease. If a new Form I-129 is filed within 30 days, the professional athlete’s employment authorization will continue until the petition is adjudicated. If the new petition is denied, employment authorization will cease. In the case of a nonimmigrant with H-1B status,employment authorization will automatically continue upon the filing of a qualifying petition under 8 CFR 214.2(h)(2)(i)(H) until such petition is adjudicated, in accordance with section 214(n) of the Act and 8 CFR 214.2(h)(2)(i)(H);원우진 변호사
