저는 한국에 있고 9월8일에 F2 비자로 미국에 들어갈 예정입니다.
한편 휴스턴 베일러의대에서 H1B 비자를 진행중에 있습니다.
H1B를 visa stamp를 받아서 들어가면 좋겠지만..
아이들 학교문제로.. 일찍 들어가려고
9월8일 비행기표를 사놓은 상태라서..고민중인데..아래와 같은 메일을 오늘 받았습니다.
한국에 머무는 사람에게 H1B 주는 것과
미국에 F2로 들어와 있는사람에게 H1B주는것이 다르게 진행이 되는건가요?
제 생각에는 같은일 같은데.. 뭐가 복잡하네요..

Dr. Darlington is correct to say that it is possible for a person to change status in the U.S., but in your case I think it’s a risk if you enter on the F-2 and change status immediately to the H-1B after you enter the U.S.
If you change your status immediately after you enter on the F-2 visa, the H-1B change of status petition that we file for you can be denied based on the fact that you presented yourself fraudulently when you entered the U.S.
I rather not risk having your petition be denied. If you must enter the U.S. on the F-2 first, then I would ask that you and the Department wait for a couple of month before Baylor files your change of status to the H-1B visa. This will of course delay your start date at Baylor. It might be best if you can just wait overseas and enter on the H-1B instead of processing a change of status in the U.S.
I know you and Dr. Darlington would like you to begin your employment on October 1st, but there are still things that needs to be done before the filing of your petition. We can aim for October 1st, but I cannot guarantee that you will be able to start on time. Please let me know how you want to proceed. I need to know before I file your case to immigration. If you decide to wait until you enter on the F-2, then the case will be on hold until a couple of months after you enter (which would mean probably filing your H-1B in November/December).
If you can wait and enter on the H-1B, then I will file your case for consular processing for an effective date of October 1st.
