    TITLE: Use papers published in Korea to support EB2NIW

    Journal publications are often used to support an EB2 National Interest Waiver application. However, if you have only a few journal publications (or even none at all) in the United States, but you do have papers published in Korea, can you still apply for EB2NIW?

    Over the past 12 years, we have seen many successful cases in which Korean clients who had very few journal publications in the United States received approval of their EB2NIW applications. In the following article, we will provide a real-life example of a successful case where the client did not have many U.S. journal publications:

    A Korean EB2NIW applicant received a Ph.D. in the United States and a Master’s degree from Korea. At the time of filing, she was doing important research on the role of Chemokine, Somatostatin, on plasticity mechanism of adult stem cells, especially liver stem cells. She had 2 papers in professional journals published in the United States and 2 papers in journals published in Korea. This client was worried about her limited journal publications in the United States. Based on our prior experience, we did extensive legal work to analyze and document her EB2NIW. Her EB2NIW was approved in three months without RFE.

    In her case preparation, we provided CIS with a detailed introduction to the reputation and influence of the Korean journals that published our client’s scientific papers. Based on the evidence that we provided to CIS, we argued that the scientific papers published in the Korean professional journals had an international impact. We noticed that not all foreign professional journals (i.e. journals published outside of the U.S.) had international impact, and many foreign journals were only distributed in a specific country with a limited readership in a particular area (for example, a Korean journal published only in Korea, and circulated only within Korea). To differentiate these types of regional or country-specific journals from the internationally-circulated Korean journals that published our client’s papers, we helped our client provide extensive evidence to prove that the Korean journals were renowned both nationally and internationally. We also showed that these journals had English version websites, which demonstrated that the readers of the journals were not limited to only Korean scientists.

    To further prove that our client’s work had a national and international impact, we helped our client prepare and submit 3 conference presentations. These poster and abstract presentations were made for and published by influential international conferences. We helped our client research and provide introductions to these professional conferences.

    Additionally, expert opinion letters are very important to an EB2NIW application. There are different types of experts who may provide opinion letters to support our client’s EB2NIW. We advised our client to request opinion letters in a diversified manner to ensure that the CIS adjudication officer is provided objective opinions from a wide range of experts in the field. We helped this client prepare and submit 7 letters from 5 different types of experts.

    We also focused on the significance of this client’s research and her leading role in ongoing NIH research projects. This Korean client made significant novel research findings in NIH research projects. Her research was to investigate the fundamental issues concerning the homing mechanisms of liver stem cell and the role of some molecular cells in the homing of liver stem cells within damaged liver that affects millions of people in the U.S. She played a leading role that was evidenced by a new NIH research funding application in which our client’s publication is a key reference in the ongoing application. In this ongoing application of NIH study grant, a joint effort to explore the mechanism of liver stem cell activation by the Stem Cell Program of UF was planned out. Our client’s major role was to determine if some cells had a specific role in an injured liver. This project is at the leading edge of modern biology. It determines the extent each of these molecules play in the oval cell aided regenerative process, thus leading to a better understanding of the liver regeneration process as a whole.

    A successful EB2NIW application will have a comprehensive evidence preparation and in-depth legal analysis. Although this client only had 2 journal publications in the United States, we helped this client convince the CIS officer that her leading edge research and contributions have a national and international impact, and she was qualified for the classification sought.

    This green card application in EB2NIW was approved in 3 months without RFE.
