혼동의 시작은 다음 때문입니다.
2006년엔가 SSA (Social Security 관할 기관)에서
E/L 배우자는 별도의 승인이 없이 일을 할 수 있으므로
EAD card가 없이도 소셜 번호를 발급해 주겠다고 발표를 했습니다.

For those with a double asterisk (**) (non-immigrant E-1, E-2, and L-2 classifications), the spouse is also authorized to work without specific DHS authorization. When the E-1, E-2, or L-2 spouse applies for an SSN card and does not submit an EAD as evidence of employment authorization, he/she must submit, in addition to evidence of immigration status, evidence of a marital relationship to the principal E-1, E-2, or L-1 alien.
하지만, 이민법이 E/L 배우자가 EAD card가 없이 일을 할 수 있다고 바뀐 적도 없고, 이민국에서 그렇게 발표한 적도 없습니다. 다음에 좋은 설명이 있군요.

Does an E-2 spouse still need an Employment Authorization Document in order to work legally in the United States?
While it is now clear that an EAD is not required in order to obtain a Social Security Number, there is likely to be some confusion in the immigrant community about whether an Employment Authorization Document is still required in order for an E-2 spouse to be able to work legally in the United States.
The SSA announcement states that the E-2 spouse is “authorized to work without specific DHS authorization.” That simply is not correct. Despite the SSA’s recent announcement, the Department of Homeland Security has not changed its policy of requiring a valid Employment Authorization Document for the E-2 spouse before the E-2 spouse can lawfully work.
