최근에 이민국이 까다로와져서 re-entry permit을 신청할경우 핑거까지 기다렸다가 귀국해야 한다고 들었습니다.
제가 가지고 있는 AP (Advanced parole)이 만료가 되어가서 갱신하려고 하는데,AP 는 어떤가요?
그냥 신청만 하고 귀국해도 되나요, 아님 기다렸다가 핑거까지 해야 하나요?

AP는 핑거 안합니다만, 승인되어 발급되면 손에 쥐고 출국해야 합니다. 승인전 출국하면 AP 신청, 승인 취소됩니다.

그리고.. 입국시 제가 지금 비자가 없는데.. 비자를 새로 내야 하나요?

* AP 신청 설명서를 보면, 다음과 같이 승인전에 출국을 하면 신청을 포기한 것으로 간주한다고 나옵니다.

* “AP를 새로 신청하고, 만료가 되지 않은 AP를 가지고 출국하면 될까요?”
–> 다음 설명에, 기존의 AP가 유효할 때 재입국하면 괜찮지만, 그 이후에 입국하는 것은 안된다고 나옵니다.

Previously Approved Advance Parole

The USCIS stated that if a person has an advance parole and applies for a new advance parole while in the United States, s/he may travel and reenter the U.S. using the already approved advance parole. The person must return during the time period permitted under that advance parole that was approved before the person’s departure. The USCIS specified that the person cannot remain abroad after the expiration of the first advance parole and then seek to enter on the second one after it is approved.

* “그리고.. 입국시 제가 지금 비자가 없는데.. 비자를 새로 내야 하나요?”
–> 유효한 AP가 있다면, 비자는 필요없습니다.
그리고, H1B/L1 비자가 있으면, 애초에 AP가 필요없습니다.
