I just heard from a school lawyer about a critical issue in my application of PERM special handling.
When my school hired me, the advertisement said that applicants should complete all the requirements by August 1. However, with the Dean’s permission, I extended the completion date to September 1, and I finally completed on August 2 (only one day after the original date specified in the advertisement.).
The school lawyer said that the school cannot file my application as a special handling case because I completed my degree one day after the date specified in the advertisement.
I am trying to find any information related to my case, but I couldn’t find any.
Could you provide your experience or any information that can resolve my case?

저는 더 심한 경우였는데요. 님의 경우는 하루 차이났었지만, 전 한 학기 차이났었습니다. tenure-track 포지션이었고 가을학기 임용되기 전, 박사학위 취득에 관련된 모든 requirements를 8월 1일까지 끝내야 한다는 것도 job ad에 있었습니다. 임용된 학교에서 양해를 했고, LC 들어갈때 약간의 문구로 커버했고 1달만에 승인 받았었습니다. special handling for college professor 로 들어갔었고요.

ETA 9089 Form 14번, Specific skills or other requirements 쓰는 란이 있습니다. (이 form을 보신적이 없으면, USCIS 웹사이트가면 PDF로 다운로드할 수 있어요)

거기에 specific skills를 나열한 이후에 아래 문구를 넣어달라고 하세요.

The university considers the applicant is acceptable if he/she has met the requirements for Ph.D. degree, while the degree will be officially conferred at a later date.

님이 8월 2일에 모든 requirements를 마쳤어도, Ph. D가 transcript에 찍히는 건 몇 달 이후니까 위의 문구가 도움이 될 겁니다.

학교 변호사가 이걸로도 안 된다 하면, 외부 변호사 사서 본인이 직접 돈 주고 영주권 한다 하세요. 시간 질질 끄는 거 보다 본인애 변호사 사서 빨리 진행하는 것도 정신건강에 도움됩니다.

답변 감사합니다. 내일 학장과 HR 이랑 미팅이 있는데, 뭐라할지 몰겠네요. 변호사 바꾸고싶어도, PERM은 무조건 학교변호사를 통해야 된다고 하더라구요… 하튼 소식있으면 또 올리겠습니다.
