    We recently helped a neuroscientist who had only 4 published papers and 27 research citations obtain an approval of her NIW petition in 3 months and 18 days without a Request for Evidence (RFE).
     
    The client (case number: S-1453) has performed cutting edge research studies on neural mechanisms of ocularmotor system for the past 10 years.  She received a Ph.D. degree in Biophysics from a national academy in China.  She currently works as a Postdoctoral Fellow at one of the world’s most distinguished institutions of research.   Through documentation of evidence on her research achievements, we have successfully proved that her past and current research specializing on eye movements, motor learning and circadian rhythm is within the areas of national interests such as brain research and clinical medicine.  Her research career is set on a stellar course that is bound to have a long-term impact on the brain health of all Americans.
     
    The applicant’s research has furthered our knowledge on how to generate motor commands in the brain, satisfied our curiosity on how the brain process the information during eye movements, renewed our understanding on motor learning and circadian rhythm, and occupied the leading position in the worldwide brain research studies. Furthermore, her findings offered clinicians physiological data and principles, not only for early diagnosis of neurologic diseases like Alzheimer’s disease, Parkinson’s disease and stroke, but also for an effective treatment for patients with movement disorders or circadian rhythm disorders. It is necessary to investigate neural mechanisms underlying eye movements, motor learning and circadian rhythm in healthy brains, since more and more persons are in an urgent need for this knowledge to help them and their family now and in the near future. At this point of view, research studies on how the brain control the eye movements, guide the motor learning and set the circadian rhythm are crucial to the United States.  She has been a critical scientist in these projects on neural mechanisms of eye movements and motor learning.

    To establish our client’s uniqueness and innovativeness to serve the national interests, we argued that her current position and ongoing projects supported by government agencies such as the National Institutes of Health (NIH), Chinese Academy of Science (CAS) and National Natural Science Foundation of China (NSFC) rely on her previous research findings and expertise in behavior assays, pharmacology, computational neuroscience, and brain anatomy, as well as her intellectual power and experience in electrophysiology, behavior neuroscience, and computational neuroscience.
     
    We helped the client establish that her research achievements have some degree of impact/influence on the field as a whole, by documenting her 2 first-authored paper, 2 co-authored papers, 10 conference presentations, 3 review citations, 27 research citations, and media reports, among other documents.   Additionally, we carefully drafted seven (7) expert opinion letters based on the client’s personal statement and other information provided.

    The successful adjudication of the client’s EB2NIW petition in 3 months and 18 days without a RFE reflects the fact that the client’s case was well-prepared and well-organized by our successful systematic evidence preparation.

    The EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application.   The applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
