    한인 나노기술 연구원의 EB2NIW 승인 사례

    최근 저희 로펌은 나노과학공학 분야의 한인 연구원이 EB2NIW의 영주권 승인을 6개월만에 받을 수 있도록 도와드렸습니다. 손님의 I-140 EB2NIW신청서는 USCIS Nebraska Service Center에 2013년 11월27일에 접수되었고 2014년5월31일에 추가서류 요청 (Request for Evidence: RFE) 없이 승인되었습니다.

    저희는 다음의 EB2NIW 법적 기준에 근거하여 손님 케이스의 개요를 정리하였습니다.

    a) 국익의 영역

    미 국립연구소에서 Post-Doc연구원으로 있는 저희 손님은 미 국립과학재단(National Science Foundation, NSF), 미국방부(Department of Defense, DOD)를 포함한 정부기관들에 의하여 지원되고 있는 연구 프로젝트에서, 자기 반도체 나노탄소 구조체(magnetic semiconductor nanocarbon structures) 및 나노 자전기 나노입자(nanomagnetoelectric nanoparticles)를 연구하고 있습니다.
    Magnetic graphene & 3D electronics에 대한 손님의 독창적인 연구활동이 단지 지방적이거나 특정 기관에 제한되어있는 것이 아니라, 나노기술에 관련된 장기적인 미 국익, 특히, 새로운 등급의 나노스케일상 기능성소재(functional materials in nano scale) 개발과 의료분야에 적용되는 나노공학 연구가 미 국익에 어떻게 실질적이고 중요한 의미를 가지고 있으며 직접적인 연관이 있는지를 입증하기 위해 저희는 설득력있는 논증과 증거를 제시하였습니다.

    오늘날 과학자/공학자들은 더 좋은 내구력, 더 가벼운 중량, 증가된 분광 스펙트럼 제어력, 더 높은 화학 반응성과 같은 향상된 (나노스케일 소재) 속성들을 활용하기 위해 나노스케일 소재를 신중하게 만드는 다양한 방법들을 연구하고 있습니다. 정보기술 연구를 위한 기능성 나노소재 제작 및 특성화(functional nanomaterials fabrication and characterization)분야의 미국의 계속적인 리더십을 확보하기 위한 NSF 및 DOD 연구 프로젝트의 변함없는 진전을 위하여, 나노전자(Nanoelectronics) 연구에 있어서 신청인의 역할은 결정적이고 반드시 필요하다는 사실을 논증하였습니다.

    b) 고급학위

    신청인은 본인의 전문분야에서 석사 또는 그 이상의 학위를 취득하였다는 점을 입증하였습니다. 그는 기계공학 석사 및 박사 학위를 미국 내에서 취득하였습니다.

    c) 국익을 위한 신청인의 고유성(Uniqueness) 및 혁신성(Innovativeness)을 입증하는 증거

    저희는 신청인이 노동허가(Labor Certification) 신청서에 명확히 설명될 수 없는 독특한 기술, 지식, 연구능력을 소지하고 있다는 점과, 손님의 전문성과 연구경험이 국익과 연관되어 있는 현재와 앞으로의 연구 프로젝트에 필요하다는 점을 보여주였습니다. 손님의 현 연구직과 진행중의 프로젝트는, 그의 이전 연구발견과 더불어 탄소기반 나노구조체(carbon-based nanostructures), 나노 크기의 소재 제작(nano-sized materials fabrication), 소자의 제조(devices fabrication) 등의 연구분야의 전문성에 좌우되어 있을 뿐만 아니라, 탄소기반 소재의 역학, 자성 및 전자(mechanics, magnetism, and electronics of carbon-based materials) 분야에서의 그의 지식과 폭넓은 전문적인 경험을 또한 필요로 하는 있는 바, 이것들은 그의 과거 및 현재의 연구 발견들에 근거하고 있다는 점을 논증하였습니다.

    이러한 논의사항들을 제시하기 위해서, 저희는 신청인이 현 /이전 상사로부터의 소견서를 주의깊게 준비할 수 있도록 도와드렸습니다. 신청인의 현/이전 연구활동과 국익에 대한 연관성은 손님의 연구분야와 활동을 잘 알고있는 전문가의 소견서에 명확히 묘사되었습니다. 또한, 신청인과 함께 연구활동을 하지 않았거나 신청인을 직접 모르지만, 그의 지식과 전문성, 그리고 국익의 관점에 비추어 본 그의 연구능력을 평가하고 논의할 수 있는 독립적인 전문가의 소견서 2부를 준비할 수 있도록 도와드렸습니다.

    d) 노동허가 조건의 면제 (Waiver of the Labor Certification Requirement)

    전문가 소견서에서 저희는 노동허가 신청서가 손님의 케이스에 적합하지 않는 이유에 대한 상세한 설명을 하였습니다. 현재 연구활동에서 손님의 부재가 미 국익에 불리하게 영향을 줄 수 있다는 점을 보여주기 위하여, 저희는 연구 프로젝트에서 손님의 중요한 역할을 묘사하였으며, 진행되고 있는 프로젝트의 진척은, 차세대 전자를 위한 탄소기반 자성소재 (carbon based magnetic materials for next generation electronics), 약물전달을 위한 다기능성 나노입자 (multifunctional nanoparticles for drug delivery), 나노 자기터널 결합 구조체에 근거한 저에너지 전자 소재 (low energy electronics materials based on nanomagnetic tunneling junction structures) 등의 손님의 이전 연구발견에 근거한 새로운 기술의 연구개발에 좌우된다는 사실을 설명하였습니다. 이러한 발견들은 NSF 및 DOD 연구 프로젝트의 향후 발전에 중대한 신청인의 독창적인 연구 공헌입니다. 이러한 기술의 독창성은 노동허가 신청서에 상세히 기술될 수 없다는 점을 결정합니다.

    e) 국가 차원의 이익과 분야 전체에 영향을 미치는 신청자의 이전 업적을 증명함

    A nanotechnologist had his EB2NIW petition approved in 6 months.

    Recently, our law firm helped a Korean researcher in the field of nano-scale science and engineering obtain an approval of his green card petition in EB2NIW in 6 months. His I-140 EB2NIW application was filed at the USCIS Nebraska Service Center on November 27, 2013 and was approved on May 31, 2014 without a Request for Evidence (RFE).

    We have prepared is a synopsis of his approved case based on the following EB2NIW legal criteria:

    a) Areas of National Interest

    The applicant is a postdoctoral fellow at a US national laboratory, conducting cutting edge research on magnetic semiconductor nanocarbon structures and nanomagnetoelectric nanoparticles, funded by the government agencies, including National Science Foundation (NSF) and Department of Defense (DoD).

    We persuasively argued and presented evidence to prove how the applicant’s original research work on magnetic graphene and 3D electronics would be on a national scale, not just limited to a single region or entity, and how his leading edge work has important/practical significance and direct links to the U.S. long-term interest with respect to nanotechnology, particularly in such areas as the developments of new class of functional materials in nano scale, and research on nanoengineering for medical applications.

    Today’s scientists and engineers are finding a wide variety of ways to deliberately make materials at the nanoscale to take advantage of their enhanced properties such as higher strength, lighter weight, increased control of light spectrum, and greater chemical reactivity than their larger-scale counterparts. We have argued that the applicant’s role in nanoelectronics research is critical and indispensible for the consistent progress of NSF- and DoD-projects in this area of research to ensure U.S’ continuous leadership in the field of functional nanomaterials fabrication and characterization for information technology research.

    b) Advanced Degrees

    The applicant proved that he has earned a master’s degree or higher in his area of specialty in order to meet this required criterion. He received his Ph.D. and M.S degrees in Mechanical Engineering in the U.S.

    c) Evidence to Establish Applicant’s Uniqueness and Innovativeness to Serve the National Interest

    For this important criterion, we showed that 1) the applicant possesses distinctive technical skills, knowledge and research abilities that cannot be articulated on an application for labor certification, and 2) his expertise and prior research experience are required for his current and future research projects that are connected to the U.S. national interest. We argued that his current position and the ongoing projects rely on his previous research findings and expertise in carbon-based nanostructures, nano-sized materials fabrication, and devices fabrication, as well as his intellectual power and broad professional experience in mechanics, magnetism, and electronics of carbon-based materials that are rooted in his past and current research discoveries.

    To present such arguments, we helped the applicant prepare current/past supervisor opinion letters in a careful and thorough manner. The applicant’s past and current research, and their links to national interests were precisely delineated in the opinion letter of the experts who are very familiar with his work and areas of his specialty. We also helped him draft and prepare two (2) opinion letters of independent experts who have not worked with the applicant and have no direct knowledge of him, but who are able to evaluate and discuss his knowledge, expertise, and research abilities in view of national interest aspects.

    d) Waiver of the Labor Certification Requirement

    In expert opinion letters, we provided a detailed explanation of why a labor certification application is not appropriate in the client’s case. To show that the applicant’s absence in his current research activities would adversely affect the U.S interests, we helped him describe his roles in the projects, and the fact that the future progress of the current research projects depends on his continued development of the novel technologies based on his prior research discoveries of carbon based magnetic materials for next generation electronics, multi-functional nanoparticles for drug delivery, and low energy electronics materials based on nanomagnetic tunneling junction structures. These discoveries are the applicant’s personal original contributions that are critical to the future development of the NSF- and DoD projects. The novelty of these technologies determines that they cannot be articulated on a labor certification application.

    e) To Prove That Applicant’s Prior Achievements Have Some Degree of National Level Benefits and Impact/Influence on the Field as a Whole

    We helped our client establish his research accomplishments are so significant that the degree of benefits and impact demonstrated by his research is greater than most of his peers in the field. This can be proved by documenting the applicant’s actual accomplishments in the field. Through our comprehensive evidence preparation system, we thoroughly documented his 7 first-authored papers, 11 co-authored papers, research/review citations, awards, professional media reports, 4 opinion letters, among other documents.

    When we prepared the client’s documentation, we paid close attention in organizing his evidence in a way that the CIS review officer may find critical evidence easily and quickly. Our evidence preparation system ensures that our clients present all their evidence according to the legal requirements of EB2NIW.

    The successful adjudication of the applicant’s EB2NIW petition without a RFE reflects the fact that the applicant’s documents were well-prepared and well-organized by our systematic evidence preparation.

    The EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application. However, the applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
