    We helped a Computer Vision scientist in the field of Computer Science receive CIS Approval of EB2NIW Petition.

    Lately, our law firm helped a computer vision engineer who had 10 published papers obtain an approval of his NIW petition without a Request for Evidence (RFE).

    The client (case number: S-1456) received a Ph.D. degree in Electrical Engineering from a university in the U.S.  He currently works as a Software Engineer at the world-leading producer of Global Positioning System (GPS) with applications to automobiles, marine, aviation, and other areas.

    National interest (EB2NIW) cases require that the emphasis rest with the overall value and potential of the beneficiary/applicant’s individual contribution to the U.S. — not just the fact that he/she are working in a field of high national interest. The alien/applicant may qualify by being found to be a key or critical member of a team if it can be shown that the team function would be severely impaired without this member. Merely working in an area of national interest does not necessitate a finding of national interest qualification.

    In this case, the alien is currently working on enhancing the precision of global positioning systems (GPS) as well as identifying patterns related to driver risks from input of different sensors including cameras and inertial sensors.  Driver safety is an important nationwide issue in the United States.  Each year there are millions of motor vehicle accidents, many of them lead to deaths, injuries and property damage.  In order to develop advanced driver assistance systems to enhance driver safety, the applicant’s research work in improving the precision of GPS positioning and identifying patterns related to driver risk is crucial.  Undoubtedly, the applicant’s innovative work conforms to important national interests of the United States, in the area of accident and collision avoidance for automobile drivers.

    We also demonstrated that the alien plays a critical role in driver safety related projects, and his specific novel knowledge and expertise are required to further the ongoing projects.  We argued that the important endeavors of the projects rely on the applicant’s past achievements, by specifically describing what his prior discoveries were in computer vision, pattern recognition and machine intelligence.  We further argued that, without his presence in the United States, and his advanced knowledge in image pattern analysis, sequential pattern analysis, and software implementation of computer vision algorithms, the country would lose his highly advanced expertise and novel approaches to the development of advanced driver assistance systems.

    The alien/applicant seeking qualification for a waiver of labor certification based on services considered in the national interest must also demonstrate that he/she has a past record of specific prior achievement with some degree of influence on the field as a whole.

     The applicant in this case has made specific prior achievements that have influence in the field of Computer Vision.  Using his intensive knowledge in image processing, pattern recognition and sequential pattern analysis, the applicant has invented a novel, real-time algorithm  that was downloaded by other scientists of the field for hundred times. Notably, his leading edge work on the improvement of barcode decoding algorithms on smart phones has improved the speed and robustness of barcode decoding.  This would not only benefit a vast number of smart phone users, but also help U.S. government agencies such as U.S. customs to better transmit and collect information using mini barcodes. 

    We helped the applicant establish that his research achievements have some degree of impact/influence on the field as a whole, as described above, by documenting his 10 scientific papers, conference presentations, about 50 research and review citations, 3 invitations for peer-reviewed services, and 6 expert opinion letters, among other documents.  
     
    The successful adjudication of the client’s EB2NIW petition without a RFE reflects the fact that all the evidence and documentation of his case were thoroughly prepared and well-argued by our evidence preparation system according to the legal requirements of EB2NIW, which is very important for successful case results.
