    최근 저희는 한인 생물의학 연구원이 EB2NIW부문아래 영주권을 신청하고 추가서류 요청 (RFE) 없이 승인을 받을 수 있도록 도와드렸습니다.

    손님은 미 보건국(NIH)이 지원하는 연국 프로젝트에서 postdoc연구원으로 일하고 있으며, 망막색소상피 (retinal pigment epithelium, RPE)의 자가포식현상(autophagy)에 관한 연구를 하고 있습니다. 그는 발생생물학 (developmental biology) 박사학위를 받았습니다.  저희는 손님의 EB2NIW하에 신청서류를 준비하고 접수할 수 있도록 도와드렸습니다.

    손님의 연구는 망막색소상피(RPE)의 자가포식현상 기능을 검토하는 것에 초점을 두고 있습니다. 그의 연구 목표는 노인성 황반변성 (age-related macular degeneration, AMD)의 생물학적 치료를 위한 효과적인 약물을 개발하는데 있습니다.  노인성 황반변성 발병과 관련된 자가포식현상 역할에 관한 손님의 연구 발견들이 국가 차원으로 유익을 가져다 줌으로써, 손님의 연구프로젝트는 미국의 보건의료에 직접적인 연관이 있습니다.  노인성 황반변성 (AMD)은 65세 이상되는 미국인들 사이에서의 실명 및 시력 상실의 주요 원인이 되고 있습니다. 이러한 그룹의 사람들이 일반 인구에서 큰 비율로 증가하는 것을 볼 수 있기 때문에, 황반변성의 시력 상실은 부상하고 있는 문제입니다.  노인성 황반변성은 중심시력(central vision)을 책임지는 망막의 일부분인 황반의 퇴화입니다. 현재 약 175만명의 미국 거주자들이 노인성 황반변성을 가지고 있으며, 이러한 숫자는 2020년까지 거의 300만명으로 늘어날 것으로 예상됩니다.  손님은molecular and cellular biology, mouse behavioral analysis 의 이전 연구경험을 AMD발병과 관련된 자가포식현상 역할에 관한 연구에 적용함으로써, AMD의 생물학적 및 최종적인 치료를 위한 효과적인 약물을 개발하는 목표를 이루기위하여 미보건국 연구프로젝트를 진척시키고 있습니다. 

    손님은 5편의 논문을 출판하였으며 1건의 학회발표를 하였습니다. 저희는 저널논문, 학회발표, 50회 이상의 연구인용 기록 등을 철저하게 서류화하였습니다.  아울러 저희는 손님의 개인소견서와 보충서류를 토대로 하여 전문가 소견서/추천서 7부 초안들을 주의깊게 작성하였습니다.

    미국 외(한국 내)에 있는 EB2NIW신청자는 영주권신청을 스폰서하기 위한 미 고용주를 필요로 하지 않습니다.   신청자는 영주권 취득 후에 미국에서 본인의 전문분야의 연구직을 오퍼받을 것을 입증하기 위한 ‘Letter of Intent to Offer’를 미 고용기관으로 하여금 미이민국에 제공하도록 하여야 합니다.

    A Korean biomedical researcher in the field of biochemistry and visual science received CIS EB2NIW Approval without RFE!

    Recently, our law firm succeeded in helping a Korean research scientist apply for a green card in the EB2NIW classification and get her petition approved without RFE. 

    The client is a postdoctoral research fellow working for the NIH-funded research projects to conduct pioneering research on the function of autophagy in Retinal Pigment Epithelium (RPE).    She has a Ph.D. degree in Developmental Biology.  We helped her prepare and file documents under the immigration classification of EB2NIW. 

    The client’s research is focused on examining the function of autophagy in RPE.  The aim of this project is to develop efficient drugs for biological treatment and final cure for age-related macular degeneration (AMD).  The client’s research projects are directly linked to the health care of the United States, as her research discoveries on the role of autophagy in the pathogenesis of age-related macular degeneration (AMD) bring a benefit that is national in scope.  Age-related macular degeneration (AMD) is the leading cause of vision loss and blindness among Americans who are age 65 and older.  Because people in this group are an increasingly larger percentage of the general population, vision loss from macular degeneration is a growing problem.  AMD is degeneration of the macula, which is the part of the retina responsible for the sharp, central vision needed to read or drive.  Because the macular primarily is affected in AMD, central vision loss may occur.  About 1.75 million U.S. residents currently have advanced AMD with associated vision loss, with that number expected to grow to almost 3 million by 2020.   By applying her previous research experiences about molecular and cellular biology, mouse behavioral to her current research on the role of autophagy in the pathogenesis of AMD, the applicant is moving the NIH-funded projects forward to achieve its goal of developing efficient drugs for biological treatment and final cure for AMD. 

    The client has published 5 scholarly papers in professional journals, and provided one invited presentation at a national conference.   We have thoroughly documented her supporting evidence, including copies of journal publications, conference presentations, more than 50 research citations of her papers, etc.  Additionally, we carefully drafted seven (7) expert opinion letters based on the client’s personal statement and other information provided.

    After our meticulous preparation of her EB2NIW documents, we filed her applications to CIS Nebraska Service Center.  The EB2NIW application prepared and filed by our law firm on July 11, 2012 was approved by the CIS Nebraska Service Center on March 1, 2013 without RFE. 

    The EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application.   The applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
