이말이 정확히 무슨말인지 아시나요? 늘 그렇듯 이민국의 처사를 바탕으로 해석하면 특정 분야에서만 NIW 자격되는 사람에서 좀더 넒은 영역으로 확대될수 있다… 이말같은데

 

여러분은 어떻게 생각하시나요? 사실 석사로 취업안하고 아무런 조건없이 영주권신청이 가능하다면 그수많은 인도 중국애들 어떻게 감당할까요?

The EB-2 visa classification includes foreign workers with advanced degrees and individuals of exceptional ability in the arts, sciences, or business. Generally, an EB-2 visa petition requires a job offer and a Department of Labor certification. These requirements can be waived under existing law if the petitioner demonstrates that approval of the EB-2 visa petition would be in the national interest of the United States.

이부분이 과연 희망적인 말인가요? 아님 뭐 그냥 그럴수도 있겠다 인가요?

NIW는EB2인데 이미 중국과 인도출신은 2006년 인가 7년이 우선일자입니다. 그리고 이미 국익에 도움이 됨을 증명하는 석사이상의 각 분야에서 NIW를 신청하고 영수권을 받고있습니다. 국익에 해당하는 이민국의 해석 범위가 넗어질 모양입니다.

이민국 홈페이지에 자세히 읽어보시면 EB2 NIW를 만족하기 위해서는 아래의 항목중 적어도 3가지 이상을 만족해야한다고 되어있습니다. 단순히 석사만 있다고 NIW를 신청하실 수는 없어보이네요.

* Criteria
Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability

Letters documenting at least 10 years of full-time experience in your occupation
A license to practice your profession or certification for your profession or occupation

Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
Membership in a professional association(s)

Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations

Other comparable evidence of eligibility is also acceptable.
