신청 목적은 NIW i140 진행 하면서 제출한 모든 서류를 받아보기를 원해서 입니다.
사연은 i140 신청시 petition letter를 공유 안해줘서입니다. 결과적으로 rfe이후 deny되었습니다.
현재 재신청을 목표로 하고 있습니다.

FOIA에 제 케이스넘버를 입력하였더니 rfe와 deny되었던 응답 서류만 보내주었습니다.
그래서 새롭게 FOIA를 신청하면서 마지막에 요청사항을 문서로 보낼 수 있는 양식이 있어서 아래와 같이 적었습니다.

I would like to get a copy of all the submitted documents, esp. including the petition letter, for the NIW I140 application (the case number: LINXXXXXXXXX).

Received date of the application: MM DD, 2021
Date of the deny:MM DD, 2022

Recently I got a result from the FOIA/PA request NRCXXXXXXXXX, but there was only the responsive record. Could you please provide the copy of all the submitted documents? Thank you.

그리고 응답(completed로 바뀜)으로 제목은 No. Records로 오면서 이런 내용으로 왔습니다.
We have completed a search of Person-Centric Identity Services (PCIS). No records responsive to your
request were located. If you have reason to believe that responsive records do exist, and you can provide
us with additional information, we will conduct another search. Please forward the additional
information to the address listed above and reference the control number which appears on this
correspondence. If, after the second search no responsive records are located, you will be notified. At
that time you may appeal the determination by following the directions set forth below.

You have the right to file an administrative appeal within 90 days of the date of this letter. By filing an
appeal, you preserve your rights under FOIA and give the agency a chance to review and reconsider your
request and the agency’s decision. You may file an administrative FOIA appeal to USCIS at: USCIS
FOIA/PA Appeals Office, 150 Space Center Loop, Suite 500, Lee’s Summit, MO 64064-2139. Both the
letter and the envelope should be clearly marked “Freedom of Information Act Appeal.”

무엇이 문제였을까요? 제가 요청한 서류에 이름을 개인정보(이름 등)을 안넣었는데 이미 다른 신청과정에서 입력란이 있어서 안넣었습니다. 혹시 검색 정보를 충분히 주지 못해서 이렇게 답변이 온걸까요?
여기서 FOIA로 검색하니 다른 분들 조언에서는 이름만 적어주면 서류를 다 제공해준다고 되어 있는거 같아서요.

이민국에 제출된 서류를 요청하면 FOIA로 대부분 다 보내줍니다. I-140 form도 돌려 받지 못했다면 의외라는 생각이 듭니다. FOIA 서류에 Alien 번호도 기재를 하셨나요?

you’ve got to make your request specific. If your request is vague, the FOIA team will ignore.
at minimum, make a request to have a complete copy of your alien file to the USCIS. if they still refuse, you have an option to sue at district court for an invalid refusal.

But fist of all, you have to go after your lying lawyer. Report to the state bar where the lawyer’s barred and file a complaint, that is free. Follow through so that the lawyer loses his/her license. The rest of the lawyers will be very happy, one fewer competition.

그냥 entire A-file 을 요청하시면 될거같습니다.

“요청한 서류에 이름을 개인정보(이름 등)을 안넣었는데 이미 다른 신청과정에서 입력란이 있어서 안넣었습니다”
–> 중복된 정보를 요청한다고 생각되시더라도 요구하는 님의 개인정보는 공란에 무조건 모두 기입하세요. 이것이 없으면 검색불가로 바로 판정하고 이렇게 돌려보내기도 해요. 검색요원들은 자기네들에게 정해진 프로토콜대로 하기때문에 어디에 중복된 개인정보가 있는지 찾지 못할수 도 있어요,
