오늘 에지워러의 한 아파트 1년 렌트 리스 계약서에 사인하고 security deposit, move in/out cost, 1st month rent를 check로 써 주고 왔구요.

그런게 갑자기 문제가 생겼습니다.

남편의 영주권 LC에 오딧이 걸려버려서 미국 밖으로 나가게 되었어요. (H1B가 6개월도 안 남은 관계로…)

그래서 이미 싸인한 리스 계약서를 무효화 할 수 있는 방법이 있는지 해서요.

일단 Landlord에서 전화 했는데 전화를 안 받더라구요. 그래서 메세지는 남겨놨는데 모르겠습니다.

위약금을 물고라고 취소할 방법이 있을지요.

리스에는 딱히 렌트 늦게 냈을 때 말고는 penalty 가 씌여 있지 않네요.

이럴 땐 어떻게 해야 하나요?

I would talk to the landlord first. Just explain what’s happened. If he’s reasonable, he will refund in full. Because your case is beyond your control and your family must go outside U.S. by law, i think the landlord will accept cancellation. Per my understanding, 1st month rent and Move in/out fee should be anyhow refunded to you because the leasing period is not started yet. Also, the security deposit is to cover landlord’s economic loss in case the tenants damage the property during their tenancy. If still the landlord wants to keep some of the deposit, i think he should prove the loss he would suffer from this cancellation, which I don’t see because you just signed it today. So, just call and explain.
