제 LC PD 는 7/30/10 입니다
audit 에 결려있습니다.
제 h1b는 6/30/11 6년쨰 에 끝이 납니다.,
여기서 제가 h1b 기간 동안 한국에 나가잇었던게
한 50일쯤 넘습니다,. 그래서 recapture 를 해서 그기간을 쓸수 있는데..
이떄 recapture request 와 7th year h1b를 같이 신청 할수 있나요?
애매해서요,,아님 따로따로 신청해야 하나요..
아래 나와잇는 365 이 recapture 를 해서까지인지 아님
그거 따로 인지 따로면 7th 는 recpature 받고 해야되는건 알겠는데..
누군된다하고 누군 안된다 해서요,,,
답변 부탁드립니다..Extension requests under AC21 §106(a) may be made in a petition that also contains a request for an extension of stay that reaches the maximum 6 year limit. USCIS adjudicators should first determine the amount of H-1B extension time that may be granted to reach the 6-year limitation of stay, then determine if the labor certification or I-140 petition was filed at least 365 days by the conclusion of the 6-year limitation of stay in such instances. If so, then the one year AC21 106(a) extension may be granted. However, in no case can an extension be granted for more than a three-year period of time.
