안녕하세요. 저는 현재 STEM OPT로 일하고 있는 학생입니다. 최근 대학원에 새로 입학을 하게 되었는데요, 입학 허가증을 받고 한국에 다녀와도 될지 궁금해서 게시글 올려봅니다.
제 F1은 2023년 5월에 만료가 되었고, 그 후에는 계속 OPT->STEM OPT를 통해 현재까지 일하는 중이었습니다.
그런데 새로 진학하게 된 대학원에서 F1 갱신은 굳이 필요가 없고, SEVIS transfer 만 하면 된다고, 출국을 하지 말라고 하는 것이었습니다. 새로 비자 면접을 보지 말라고요. 그래서 예전에 다니던 학교의 인터네셔널 서비스에도 물어보았습니다. 받은 답변은 다음과 같습니다.

Are you planning to have your SEVIS record transferred to the new school? You should plan to have your current SEVIS record transferred, for this process you will need an acceptance letter and transfer form from the new school and will need to submit the transfer out request form with the acceptance letter and transfer form attached, you will find the transfer out request form by clicking the highlighted link below.
Since your STEM OPT is still valid with active employment you should not have your SEVIS record transferred before (날짜) as that is when your STEM OPT is due to end, if your SEVIS record is transferred before your STEM OPT ends then the transfer process will automatically end your STEM OPT and you would be required to immediately stop working.
Since your F1 visa has expired already this may be why you have been informed not to travel outside the US as you will have to have your F1 visa renewed before you can return to the US, and the new school cannot guarantee you will be issued a renewal of your F1 visa.
You are not required to leave the US as you are currently still in valid F1 status even though your F1 visa has expired, the F1 visa only needs to be valid when traveling and reentering the country. No school can guarantee the American Embassy will issue/renew an F1 visa as the issuance of a visa is determined by the Embassy alone, no matter if you pay the SEVIS fee, the SEVIS fee is not related to the issuance of a visa, the SEVIS fee is to activate the record/I-20 that was issued.

그런데 저는 집에 돌아가지 못한 지 거의 4년이 되었습니다. 한번 쯔음 한국에 다녀오고 싶은데, 지금 나가면 비자에 문제가 생길까요? 인터뷰를 보고도 F-1을 다시 받지 못할 가능성은 얼마나 되는지요? 학기가 시작하고(학기는 여름학기라 7월에 시작을 합니다.), 겨울 쯤 가서 비자를 다시 신청해도 괜찮을까요?
내년에 집에 경사가 있어 정말 다녀오고 싶은데, 이 경우 어떻게 하는 것이 제일 좋을까요? 감사합니다.

“미국땅을 떠나지말고 비자를 유지한채로 학교만트랜스퍼하는것” <- 학교에서 해주는말이 최선책임

왜냐하면 자기나라돌아갔다가 F비자 재신청할때 받을수있다는 보장이없음 (“the new school cannot guarantee you will be issued a renewal of your F1 visa.”). f1->영주권받을때까지 10년넘게 가족들이랑 떨어져서 자기나라 안돌아간 사람도 봤음. opt한거보면 미국에서 졸업하고 취업도하고싶을거같은데 지금 나갔다가 미국유학길 끝날수도있음. 특히 요즘같은 시기에 나라면 안나갈듯. 근데 뭐 본인선택이니까 알아서.

요즘 F1 비자 못받을 줄 몰랐다가 못받아서 이국유학 날리겠다는 케이스를 종종 봅니다. 지금처럼 안 좋을 때 한국갔다오는 거는 도박이라고 봅니다.
