Security Deposit을 돌려주지 않아 전 집주인에게 전화 연락을 해보니 이런 핑계 저런 핑계를 빌미로 돈을 돌려주지 않으려고 합니다. 언제까지 돌려주지 않으면 Small Claim Court에 가겠다고 했는데 맘대로 하라고 하네요… 겁이 없는건지 자신이 있어서 그런건지… 제가 사는 뉴져지의 경우 집을 비우고 30일 안에 SD를 돌려주지 않으면 두배이상 돈을 물어줘야 하는 규정이 있습니다.

상식이 통하지 않는 집주인에게 나 같은 tenant도 있다는 걸 보여주기 위해 부득히 법의 힘을 빌리려고 합니다. Small Claim Court에 가보신 경험이 있으신 분들의 경험담을 알려주시기 바랍니다. (참고로 file에 필요한 모든 서류는 주정부 웹사이트에서 자료를 받았습니다.)

You file for a claim at superior court.(about $20 + $30 for delivery but you get this money back if you win). A sheriff delivers the notice to the defendant( your landlord) You go to court on the court date (about a month from the date you file). You, the plaintiff make the argument. The defendant makes their argument. The judge makes decision. Bring all papers or evidences or witnesses. If you are weak in English, bring a paper that you write down about the case. You can bring your friend as an interpreter or ask for a Korean-English court interpreter(usually free, but ask if it is) too. Ask any questions you have at the small claim office in the court when you file. Don’t forget to be polite and to call the judge “your honor” or “Sir or Ma’am” when you talk in court. Good luck!
