일단 기본적인 룰은, 1년간의 학교 공부를 3년간의 전공과 동일한 풀 타임 직장 경력으로 대체가 가능 하다는 것입니다. 하지만 학교 공부한 기간이 아무리 오래 되었어도, 동일 전공에서 공부한 것이 아닌 이상은 교양과목 2년 밖에 인정받지 못하고 6년의 직장 경력이 필요합니다. 따라서 대개는 6년간의 확실하게 증명할 수 있는 직장 경력을 가지고 동일 분야에서 H-1B를 신청하는 분에게 많이 사용되고 있습니다.
질문하신 분의 경우 5년의 대학교육이 있었지만 전공이 다르며, 2년동안의 직장경력이 있었지만 세금기록이 없다고 하셨는데, 질문하신 내용만으로는 판단이 불가능하여 성적증명서를 확인하고 경력을 따로 증명할 수 있는 방법을 찾아보아야 하겠지만, 가능성이 높지는 않은 것으로 보입니다.
J-1의 경우는 많은 분야가 있는데, H-1B 대용으로 많이 사용되는 Trainee의 경우라면 조건이 까다롭지 않으므로 충분히 가능성이 있을 것으로 생각됩니다. 단 이경우 반드시 일단 출국해서 외국(한국)의 미대사관에서 인터뷰를 통해서 비자를 받아야 합니다.
