United States: Employers Report a Small Number of PERM Prevailing Wage DeterminationsSince Tuesday, a handful of prevailing wage determinations have been issued for PERM labor certification cases, though the Department of Labor has not said whether it has resumed full-scale prevailing wage processing.

Employers have begun to receive a very small number of Department of Labor (DOL) prevailing wage determinations (PWDs) for PERM labor certification cases in the last several days, based on wage requests made in early June of this year. Notwithstanding these reports, DOL has not announced whether it has lifted its suspension of full-scale PWD processing.

As we have reported, DOL temporarily stopped most PWD processing so that it could devote its resources to reissuing 4,000 wage determinations for H-2B temporary workers in compliance with a federal court order. Since at least early June, employers waiting for PWDs have been unable to file PERM applications. As a result, foreign employees reaching their maximum six years in H-1B status may be unable to obtain extensions past the sixth year. Other foreign employees have children nearing age 21 who may lose the opportunity to attain permanent residence with their parents.

What This Means for Employers

Employers should not assume that PWD processing has returned to normal or that long-pending PWD requests will be processed soon. Though the reports of PWD issuance are a modestly encouraging sign, many questions remain unresolved. DOL has not said whether it has reallocated resources from H-2B back to PERM PWD processing, or when it expects to work through the backlog of PWD requests that has accumulated over the last several months. While the processing delays persist, employers should continue to contact their designated Fragomen professionals as soon as possible if employees or their family members are at risk of H-1B “max-outs” or child “age-outs.”

Fragomen, along with the American Council on International Personnel (ACIP), the American Immigration Lawyers Association (AILA) and other allied groups, continues to urge DOL to consider solutions to alleviate the adverse consequences of the PWD delays to employers and foreign nationals. We will provide continued updates on the status of PWD processing as developments occur.
