현재 OPT extension 중이고 EAD card는 2010년 8월에 expire됩니다.
2009년 4월에 PERM application이 submit 되었으나 살펴보니 2009년 1-2월까지 처리가 되었을꺼라는 이야기가 있는데 과연 4월에 접수된 케이스는 얼마나 걸릴까요?
이대로라면 언제나 처리가 될까 싶어서 답답한 마음에 H1-B를 고려하고 있습니다.
살펴보니 12월 8일자로 61500건의 H1-B petition이 접수 된 듯 한데, 지금 H1-B를 급히 진행하면 H1-B를 받을 수 있을지가 궁금합니다.
그리고 혹시 접수 후 cap을 넘어서게 된다면 다음년도로 자동으로 넘어가는 것인지, 다시 접수를 해야하는지도 궁금합니다.

PERM should not be anything to do with your U.S. stay, nor work authorization with current sponsor. I guess you have very narrow chance to get 140/485 filed even after PERM approved by early next year, pressumably EB-2. Please work hard to find out your options to continue to stay in U.S with current employer after 08/10. Otherwise, it’s likely to be a case to get an H-1B next year.

i think the cap-gap relief will apply to his case – his opt status will be automatically extended until october 1st, IF his h-1b is granted. if then, there will not be any problem to stay and work during the august when his ead expires and october 1st. he needs to get new i-20 for the extension though.
