제가 7월 27일이 OPT 만료인데 이번 4월에 H1B 신청이 들어갔습니다.
H1B 시작이 10월부터라고 알고 있습니다.
기간이 약 3개월 비는데
다들 자동 연장이 된다고 하셨는데 그게 H1B 받기 전까지 자동 적용되는건지
제가 어떤 action을 취해야 하는지 궁금해서 글을 씁니다.

OPT 기간이 종료하기 전에 H-1B approval notice를 가지고 학교의 DSO를 만나 cap-gap filling으로 연장된 새로운 I-20를 받으시면 됩니다. 개정된 법에 의하여 체류신분이 연장되는 것이므로, 그 외에 별도로 취하셔야 할 action은 없습니다.

OPT는 10월까지 자동 연장됩니다. status에 변화가 생겼다는 것을 보고하시면 됩니다.

이민국에서 sevis로 알아서 보고들어가기때문에 구지 취해야할 액션은 없는것으로 알고있어요. 학교에서 알아서 연락올듯..변호사한테 물어보세요~

Because this is a common problem with employees in OPT whose H-1B is subject to the cap, USCIS extends the authorized period of stay for all F-1 visa holders who have properly filed an H-1B petition and change of status request pending with the USCIS. This is called the Cap-Gap rule, and refers to the period between when your OPT ends and your H-1B takes effect.

Once your H-1B is filed your OPT time is automatically extended while the application is pending; once your H-1B petition is approved, your OPT status and employment authorization is automatically extended, enabling you to remain in the U.S. until the requested state date indicated on the H-1B petition, October 1, 2010.

Once your H-1B petition is submitted and a receipt notice has been received, you will need to speak with your DSO and request for an I-20 Cap Gap extension to be processed but you do not have to file for an extension of your OPT period.
