Nonresident alien과 Resident alien 구분에 대해 질문 드립니다.
저는 2004년 7월에 H1B로 미국에 최초로 입국했습니다.
IRS에 가서 내용을 살펴보니
2003년 부터 2005년 기간동안을 계산하던데
저는 2004년 7월부터 지금까지 1년6개월 있었지만
2003년에는 미국에 없었습니다.
그래도 제가 Resident Alien에 속하는 것인가요?
그리고 만약그렇다면 H4로 같이온 제 아내도 같은 Resident Alien 인가요?
조언을 부탁드립니다. 감사합니다.

Substantial Presence Test

You are considered a U.S. resident if you meet the substantial presence test
for 2005. You meet this test if you were physically present in the United States
for at least:

1. 31 days during 2005, and

2. 183 days during the period 2005, 2004, and 2003,
counting all the days of physical presence in 2005,
but only 1/3 the number of days of presence in 2004
and only 1/6 the number of days in 2003.

위에 글남긴 사람입니다. 저도 그걸 정리하며 궁금했던 것이 만약 2005년에만 365일 머무르면 365+0/3+0/6 해서 365, 이게 183보다 크니 만족되는 것 아닌가 그런 생각했는데요 좀 더 알아봐야겠습니다. 두번째 질문에 대해서는 Pub 519 page 10에 Nonresident Spouse treated as a Resident 라는 항목이 있는데 한 번 읽어봐야겠습니다.
