May 2009 Visa Bulletin

변호사말이 2009년 5월 1일 이후 EB2를 접수할 경우 문제가 있다고 하면서, 다음과 같은 메일을 보냈습니다. 하여간 무지 서둘러서, 4월 29일 네바스카 사무실에 서류는 도착 한 것 같은데.. 아직까지 무슨 말인지 모르겠습니다. 혹시 아시는분 있으시면 알려 주실 수 있는지요?

아래 변호사메일 중 이와 관련된 부분입니다.

If you file before May 1st, you will not get a decision on the I-485 until either the EB2 category (non-PRC & India) becomes “Current” (no waiting) again OR a waiting “line” is created and your filing date (April ___, 2009) is earlier than the date listed as the front of the line date in EB2 category in the State Dept. “Visa Bulletin”.

The advantage of filing before May 1st is that you can also file for a work permit and a travel permit. These items are available to one who is eligible and files for Adjustment of Status.

제가 보기에는 뭐 특별한게 있는게 아니라, general하게 4월 bulletin에 EB2가 한국의 경우 current였기 때문에 여행허가서와 EAD를 신청할수 있었다 하지만 5월에는 어떻게 될지 모른다는 의미로 보입니다.

제생각엔 변호사가 정신이 없는것 같습니다. non-PRC & India EB2는 historically 항상 “C”였는데 뭔 문제가 있을까요?

중국, 인도등의 EB2 컷오프에 걸려있는지 오래됐어요.
제가 그게 ‘C’로 바뀌기를 눈빠지게 기다리고 있거든요…
다행히 우리나라는 C 지만 언제 바뀔지는 정말 아무도 모르는거니
빨리 접수할수록 좋은것 같아요.
