안녕하세요. 말로만 듣던 LC 리젝을 당하니 황당하기도 해서 이렇게 질문을 드려봅니다.
2009 March에 EB-2로 audit response를 하고 기다리던중 이번달 회사 HR에서 다음과 같은 이메일을 받았답니다.글의 요지는, 회사와 변호사는 제대로 작성을 했지만 DOL 에서 실수로 서류의 내용을 overlooking 했다는 얘긴네요. 내일 HR직원과 만나 얘기를 해보니로 했는데, 뭘 물어봐야 할까요? 일단은 다음과 같은 사항이 궁금하네요. 조언 부탁드립니다.
1. 정말 우리 변호사의 실수는 없었는지
2. 만약 정말 DOL 의 실수라면 Appeal 을 더 빠른 시간에 할 수는 없는지
3. Appeal과 동시에 새로운 PERM 을 시작한다면, audit 을 피할 가능성은 있는지.(이하 이메일 내용)
We have finally received a response from the Department of Labor. Unfortunately they have denied your PERM application, which we will respond to by filing a motion to reconsider.
Unfortunately, the appeals process can take up to a year or more, so we will need to patiently wait without any updates from the Department of Labor, while the case pends.
The DOL issued the denial stating that we had not submitted a signed recruitment report, our newspaper ad did not state the location of the job, and that we did not show proper evidence of the additional recruitment steps for your PERM recruitment. All of the documentation listed above was included in the original audit response, and was simply overlooked by the reviewing officer.
We are in the process of obtaining additional documentation to submit along with the original documents, and will file the motion to reconsider as soon as we have additional documentation to substantiate the additional PERM recruitment that we did.
