Now Editing “I-94 인지 I-129s 인지 [L1B주재원비자연장]” Name * Password * Email Topic Title (Maximum Length 80) 안녕하세요 얼마전 답변해주셔서 정말감사합니다 제가 질문에 틀리고 엉성했던부분들이 있어서 수정해서 다시 정확하게 질문드리고싶습니다 한국에서 미국대기업을통해 L1B비자를 받아서 미국으로 들어왔습니다. (Blanket-L입니다) 2017/08/27 에 딱 비행기로 왔는데요... I-94와 I-129s 서류 날짜들이 안맞아서 어떤것으로 work/stay authorized가 되는지 꼭알아야합니다... 다음은 month/date/year입니다 --> I-797 (Casetype I-129) : Class : Blanket Petition / Valid from 07/18/2017 to INDEFINITELY --> I-129s : Valid until 08/09/2020 (Bottom Stamp says L1, 08/25/2020) --> I-94: 처음에 2017년에는 08/25/2020으로 받아서 입국했으나, 가장최근 2019년에 04/04/2022로 받았습니다. --> 여권안에 L1 Visa: expiration date 08/09/2022 // PED date: 08/09/2020 --> Passport : valid until 2025 --> 고용주 바뀐적없고, 포지션 바뀐적없고, H1로 옮긴적없습니다 보시면 L1 Visa의 PED date이 I-129s Endorsement하고 일치하고요, 여태까지 출입국할때마다 I-94를 새로 받았는데 쭉 08/25/2020으로 받아오곤했습니다... 그런데 마지막에 2022년로 받은것이 문제입니다 제가 변호사에게 8월에 I-129s가 expire되니, extension file하자 하였습니다 (L1비자 연장과 같은말이겠지요) 그랬더니 너는 I-94가 2022년까지라며, 그럴필요가 없다고 합니다... 여러 웹싸이트를 다 뒤져봤는데 저처럼 이상하게 I-94가 I-129s보다 더 긴 케이스가 그렇게 많지 않았을뿐더러, - 그런경우, I-94 만으로는 Stay만 할수있고, work는 안된다 - I-94가 더 짧으면 I-94를 연장하고, I-129s가 더 짧으면 I-129s를 연장해야한다 - I-129s는 Travel document/visa이기때문에 들어올때 유효하고, 들어오고나서는 I-94를 따르는것이니 I-94만보면된다 - 심지어 그렇게 길게 I-94를 준 officer의 잘못이다 등등 너무나 많은 "썰"들이 존재하네요... 저의 변호사는 I-94믿고 2022까지 미국에서 일하라고 합니다... File extension within US하면 큐가 길고 RFE걸리고 reject%이 높아서 긁어부스럼이라고 하더라구요. 과연이것이 맞는말인가요? 읽어보신분들,, 혹시 주재원 관련 비슷한 경험있으시면 알려주시면 넘나 감사하겠습니다 (Blanket-L비자였는지도 꼭 알려주십시오) 밑에 여기저기 포럼에서 떠온 글들도 첨부할게요... (I-94 가 맞다) —> If the blanket petition is valid indefinitely, that generally means the employees do not have to be concerned about the expiration date of the blanket approval. —> I-797 says that Petition Valid Indefinitely that means we can legally stay and work in U.S. on the basis of I-94 expiry date. —> In general,the expiration date of the I-129S and/or visa does not impact a foreign national who is in the U.S. in valid L-1 status. However, the blanket must be valid/unexpired in order to reapply under the blanket. (I-129s가 맞다) —> If the endorsement dates on Form I-129S define the period for which a worker is authorized for L classification, the endorsement dates are in effect equivalent to the approval dates on an individual L-1 petition issued by USCIS. A Blanket L worker would therefore be authorized for employment only during the dates of I-129S endorsement dates. If the Blanket L worker is authorized for employment only during the I-129S endorsement dates, admitting the worker and issuing an I-94 for a period of time beyond the expiration of the endorsement is, necessarily, an error by CBP. Therefore, we believe that employers SHOULD NOT rely on a Form I-94 issued by CBP to a Blanket L worker that expires on a date beyond the expiration of the I-129S endorsement.
