제가 현재 F-1인데 취직이 예정된 회사에서 H1B 신청을 들어갑니다. 제 와이프와 아이의 H-4를 위해서 I-539를 작성하는 중에 몇가지 의문점이 있습니다. 제가 작성한 답들(붉은색 강조)이 맞는지 알려주시면 감사하겠습니다.

3. Is this application based on a separate petition or application to give your spouse, child, or parent an extension or change of status? => Yes, filed with this I-539 (왜 your spouse인지는 모르겠습니다만..)

4. If you answered “Yes” to Question 3, give the name of the petitioner or applicant: => My name

g. Have you, or any other person included in this application, been employed in the United States since last admitted or granted an extension or change of status? => Yes (제가 Research Assistant로 F-1하에서 일했습니다.)

지금 H1신청 끝났는데 들어간다는걸 보면은 비영리 회사인가 보죠? 그리고 변호사를 안통하고 혼자하시는것 같은데 제 생각에는 변호사를 통해서 하는게 마음이 편하실겁니다. 알아서 다 작성해 주니까요…

저번주에 h1연장신청한 자료를 변호사가 부인꺼니 리뷰하라고 보내준 자료를 보면은
Part3, 4: 회사이름/본인(H1신청자 이름)/Spouse
Part4,g: 배우자가 일안했다면 NO 라고 하셔야합니다. h1신청자를 묻는것이 아니라 배우자가 일했는지 물어보는겁니다. 만약 배우자가 일했다면 YES이겠지요.
그리고 혹시나 맨 마지막에 보면 if you answered “NO”……..어떡게 재정적으로 서포트하냐란 질문에는: 부인입장에서 쓰서야합니다 예를 들어서, 내 남편, 이름, 이 직장을 가지고 있고 남편이 나를 서포트합니다. 남편은 현재 어느 회사에서 일하고 있고 어떤 연봉을 받고 있어서 계속 서포트 할 수 있습니다……..

539는 성준님의 배우자분이 신청하시는 겁니다.
그것만 염두에 두시면 될듯합니다. 따라서 part 4.g는 No가 되겠지요 (배우자분이 일 하신적이 없다면…)
