I-485 를 신청하고나서 첫 RFE를 받았는데요.

2007년에 국적상실을 했으면 제적등본 만 발급받을 수 있는 것으로 알고 있는데 맞는지 여쭙고 싶습니다. 가족관계증명서는 발급이 가능한가요?

제가 한국 국적을 2007년도에 상실해서(현재는 한국/미국을 제외한 다른 나라의 국적입니다), i-485를 제출할 때 제적등본을 발급받아서, 번역사에게 번역하고 notary해서 제출했었습니다. 번역할 때 제적등본은 영어로 Family Census Register라고 타이틀로 되어 있었습니다.

RFE에서는 제적등본(Family Census Register) + 가족관계증명서 상세(Family Relation Certificate(Detailed) 를 요구하는데요. 국적상실을 2007년도에 했으면 가족관계증명서는 발급이 안되는 것으로 알고있는데요. 맞나요?

RFE에 따르면 “You have submitted secondary evidence and/or a birth affidavit as proof of a birth record for the applicant. However, the evidence you have submitted is insufficient. The U.S. Department of State’s visa reciprocity and civil documents indicates the Basic Certificate(Detailed) and the Family Relation Certificate(Detailed) must both be submitted. A person who lost Korean nationality prior to 2008 can submit a Family Census Register and Family Relations Certificate (Detailed). Submit the Basic Certificate (Detailed) and the Family Relation Certificate (Detaied); OR

Submit the Family Census Register and the Family Relation Certificate (Detailed).”

The US Department of State에 의하면 한국 국적을 2008년 이전에 잃었으면 제적등본으로 대체할수 있다고 하는데요.
(Alternate Documents: A person who lost Korean nationality prior to 2008 can submit a Family Census Register “Jejeok Deungbon” in lieu of a Basic Certificate “Gibon Jeungmyongseo” and Family Relations Certificate “Gajok Kwankye Jeungmyongseo”.)

서류심사하시는 분이 실수로 이렇게 RFE를 보낸거 아닌가 걱정되기도 합니다.

서류 심사하는 분이 몰라서 RFE 보낸거 맞습니다.

지금 원글님은 정황상 “가족관계증명서” 를 발급받을수 없기 때문에 오로지 이미 제출하신 “제적등본” 만으로 인정을 받아야합니다.
