01/23/2012: H.R. 3012 Update in the U.S. Senate

• The Senate convened today. In the today’s session, H.R. 3012 (Fairness for High-Skilled Immigrants Act of 2011) was read for a second time. Further readings were objected to and the bill was placed on the calendar. In a way way, it is a positive news to see resolution of this bill soon. It is interesting to see whether Sen. Harry Reid, Majority Leader, will introduce Motion for Cloture to break the potential filibuster by Senator Chuck Grassley.

상원에서 투표,입법되는 과정을 봐도 잘 모르겠네요..아시는분 혹,안계신가요? 이것 투표로 가면 돌아버릴것 같은데…???

작년회기를 넘긴것이지,,끝난것은 아니었습니다. 오늘의사일정으로 논의한다고 되어있었습니다. 여전히 상원의원 Chuck Grassley에 의해 hold되어있는것으로 보여집니다만..민주당상원원내대표(상원다수당)의 Motion for Cloture에 의해 (이게아마도상원60표이상을얻어야) floor voting으로 가는것으로 알고있습니다(hold를 풀려면). 근데,”Further readings were objected to and the bill was placed on the calendar” 이게 무슨 action인지가 궁금하네요. 그리고 출처를 제공한 매튜오변호사는 왜 HR3012를 지지하는지 참으로 궁금합니다. 고객들이 인도사람들이 대부분인지???

당췌 봐도 어느단계에 와있는지?? 어떤 단계가 남았는지?? 저도 알수가 없네요.미국정치나 의회,,뭐 이런것 전공하신분 없으신가요? 아니면 여기 변호사님들 중에 답변을 주실 분은 안계신가요?

Rule XIV is to bypass the committee and make the process faster. In this case, it is Judiciary Committee where Chuck Grassley is one of the memebers. Now Chuck Schumer successfully evaded Chuck Grassley in committee.
Once the bill read twice, even if there was any objection, the bill successfully bypass the committee. So as of yesterday… it is treated as if the committee pass the bill.

The bill is still on HOLD, now Chuck Schumer need 60 or more to successfuly invoke a CLOTURE to break the HOLD.

qwe님 감사합니다. 그러면 현단계는 일단 Judiciary committee단계는 건너뛴것이네요. 그런데 아직 Grassley상원의원이 hold하고 있기때문에 그 홀드를 풀기위해 60표가 필요하고,만약 hold가 풀린다면 상원 floor로 voting으로 갈단계라 생각해야겠네요..근데,왜 상원민주당은 이법안을 법사위를 거치지않고 bypass했을까요? 절차를 간소화해서 빨리 통과시키기 위함인지?? 보통 법사위를 거치면서 여러 수정안이 추가되고 그래서,,누더기(?)법안이 되어야..실현가능성이 희박한데,,참 걱정입니다. 추후법안일정은 찾질 못하겠네요..언제다시 다음단계가 진행되는지??

EB Visa Bulletin Predictions for 2012

March 2012 Visa Bulletin. According to Mr. Oppenheim, employment-based priority dates will advance again with the March 2012 Visa Bulletin, very likely by at least a few months. An advance of six months is possible, although an advance of one year is not likely. Mr. Oppenheim noted that given current AOS processing times of 4-6 months, filing AOS in March is the last time to get a case possibly approved before the end of the fiscal year on September 30, 2012.

Spring, Summer and rest of FY2012. After some movement in the March (and possibly the April 2012 Visa Bulletin), Mr. Oppenheim expects to hold the priority date over the summer, and then retrogress or advance, as needed and as determined by demand over the summer. Mr. Oppenheim does not have enough data at this time to predict demand and priority date changes in the last quarter of FY2012.

여기 저기 찾아보니 홀드를 푸는 60표를 채우는 것은 쉽지 않은 일이 분명하기는 한데, Grassley 상원 의원이 홀드를 풀어버리지 않을까 걱정이 되네요.

오펜하임국장의 발언은 EB2 india에만 해당되는것인가요? EB3 ROW도 해당되는 Employment-based EB전체에 해당되는것인가요?

그럼 3순위의 우선순위 (2월초에 발표되는 3월달 우선순위) 가 4~6 개월 정도 진전된다는 뜻인가요? 이노무 법률영어는 도무지 이해가 안가. 간단한 설명 좀 부탁 드릴께요.

01/23/2012: Six Months Move-Up of EB-2 Cut-Off Date Possible in March 2012 Visa Bulletin?

AILA reports that according to Mr. Oppenheim of Visa Bureau of DOS, he does not have exact prediction for March, but because of the unusual slow demand by the USCIS, upto six months move-up may be possible, even though one-year move-up may not be likely. Reportedly, at this time, they have used up 34% of total FY 2013 visa numbers and must use upto 45% by the end of February 2012. After such rapid progression, depending on the demand, they will have to decide whether the cut-off dates should remain in stay-put or even retrogress during the Summer.
