    Thank you for contacting me to express your opposition to the “Fairness for High-Skilled Immigrants Act.” I appreciate hearing your perspective, and I welcome the opportunity to respond.

    Currently, the Immigration and Nationality Act (INA) mandates that the number of employment-based and family-sponsored visas made available to individuals of a particular country cannot exceed seven percent of the total number of visas made available per year. On November 10, 2011, Senator Mike Lee (R-UT) introduced the “Fairness for High-Skilled Immigrants Act” (S. 1857), which would lift this per-country percentage cap for employment-based visas and increase to fifteen percent the per-country percentage cap for family-sponsored immigrant visas.

    The “Fairness for High-Skilled Immigrants Act” is currently pending in the Senate Judiciary Committee, of which I am a member. As you may be aware, earlier this year, Representative Jason Chaffetz (R-UT) introduced companion legislation in the House of Representatives (H.R. 3012). On November 29, 2011, the House passed H.R. 3012 by a vote of 389 to 15.

    In addition, please know that I will continue to advocate for the Senate to pass legislation on comprehensive immigration reform to fix the broken U.S. immigration system and to reduce delays and wait times for deserving families and workers of all nationalities.
