일주일전에 여기다 올렸는데 별 반응이 없었는데, 외국애들 사이트엔 너무 많은 비슷한 케이스가 있어서 오늘 해결 했습니다.

혹시 비슷한 경우가 생기시는 분들 위해 이렇게 올립니다.

일단 간단히 제 경우를 말할게요.

1.in 2009, approved for h1b for company A. 

2.in Dec,2010, went back to korea, got a visa stamp for Company A,(expiry date 9.30.2009 ~ 9.30.2012) and came back to the states.

3. transferred to Company B in the middle of 2011, received the i-797 that has validity till 2014.

4.left the states in Dec 2011, came back in Jan 2012 with the old visa stamp for Company A(this was still valid, no problem coming through JFK), yet the expiry date on i-94 of my passport doesn’t match the one on i-797.

5. got an offer from Company C, got notified by the attorney working on my case from Company C. 

6. talked about all possible scenarios, figured it would be wise to pay a visit the local CBP office for “CORRECTION” of  the “MISTAKE”  the officer made at the port.

7. waited for 10 mins on a chair, took my current passport and i-797, came back with new i-94 that has the same expiry date as i-797  attached to my passport.

제가 다른 외국 사이트에서 돌아보고 리서치한결과 많은 경우 여권이 expire될경우 들어오실떄 i94는 그 여권 남은 기간 밖에 못받고, 그걸 깜빡하고 지내다 새여권은 생겼으나 i94는 이미 기간이 지난경우도 되게 많더라구요. 조심하시구요, 꼭 여권에 있는 i94 확인 잘하시고 이런 번거롭지만 잘못하면 either illegal staying/out of status될수 있는거 잘 기억하시고…..i797에 있는 i94만 믿고 그냥 지내시면 안되요.

저도 같은 케이스였는데 이 글 보고 CBP 가서 deferred inspection받아서 i-94 새로 받았어요. I-797A하고 여권(새로받은날짜잘못된 I-94) 만 가져가서 보여줬더니 바로 바꿔줬습니다. 너무 너무 고마워요. 안그랬음 다시 I-94연장신청하거나 인근국가로 출국했다 들어와야 했을텐데말이죠.
