H-b and employer

    hi there..fisrt of all very sorry..i don’t have korean ime system.
    anyways, i have some problem…i filed my H-1B visa and recently received approval notice..My boss own 2 and half business and his brother owns half of the business. I filed my visa under my boss and worked for business A. For some reason, they had fight and seperated then they put me business C which is running by his brother but still my boss is the half owner.
    I recently received visa and now my laywer recommend file a new petition because now i am working under my boss’s brother even though my boss is half of my currently employer. Because they use different tax number. Another word, Business A and C use different number…business C is cooperation which is owned by my boss and his brother. i am considering leaving this business and find a new job (of course same category) soon but the laywer is telling me to file a new petition under my boss’s brother. i don’t know what to do in this situation whether i need to file the new petition now or i can wait until i can find a new job (but it’s gonna be within couple months)

      I think your lawyer’s right. You must file a Change of Employer(I-129) ASAP. You may be already violating the immigration law because you are working for an employer that is not the sponsoring employer of your H1B visa petition.
      As far as the tax ids(FEIN) are different, they are, in immigration law’s view, different companies.

      i know i should work on new petition. but why i should work for a new petition? because of they use different tax id number?
