저는 EB3 로 현재 다니고 있는 회사를 통해 영주권 진행 중입니다.
오늘 변호사에게 전해줄 서류가 있어서, 만나는 김에 944 접수에 필요한 모든 서류를 준비해 갔습니다.
은행 잔고, 보험, credit report, 기타 등등 이 게시판에서 944를 접수해야 한다, 안해도 된다 논란이 있는지라,
일단 만반의 준비를 해서 만났는데, 변호사님은 944를 접수할 필요가 없다고 단호하게 말씀하셔서…
그래도 전 이미 필요한 서류 준비를 다 했고, 혹시 모르니 준비한 서류를 드리면 안되겠냐고 했더니 필요없다고 안받으시네요.
회사 통한 영주권 진행은 연봉으로 재정 증명이 되기에 944는 제출하지 않아도 된다고 합니다.
밑에 글에는 944 접수를 안해서 485가 거절된 경우도 있는 듯 한데, 이 경우는 가족을 통한 영주권 신청인가요?
아님 변호사가 현재 이민국에서 요구하는 사항을 잘 모르고 있는 것일까요?

EB2로 영주권을 받은 경우이며 회사에서 지원한 경우 입니다. 944는 제출한 기억이 없습니다. 변호사와 님은 한팀이니까 일단은 믿으시고 진행해도 될 것 같습니다. 제삼의 확인이 필요하다면 구글링이나 여기에서 확인하는 방법이지요. 저도 나름 돌다리를 두드리며 진행했으며, 944에 대해서는 들은바 없습니다.

On Feb. 24, 2020, DHS began implementing the Inadmissibility on Public Charge Grounds final rule nationwide, including in Illinois. USCIS will apply the final rule to all applications and petitions postmarked (or, if applicable, submitted electronically) on or after that date. For applications and petitions that are sent by commercial courier (for example, UPS, FedEx, or DHL), the postmark date is the date reflected on the courier receipt. USCIS will reject any affected application or petition that does not adhere to the Final Rule, including those submitted by or on behalf of aliens living in Illinois, if postmarked on or after Feb. 24, 2020.
Starting with applications for adjustment of status postmarked on or after Feb. 24, 2020, if you are subject to the public charge ground of inadmissibility (INA section 212(a)(4)), you must submit this form with your Form I-485, Application to Register Permanent Residence or Adjust Status, to demonstrate that you are not inadmissible based on the public charge ground. Please see the instructions for Form I-944 to see if you are subject to the public charge ground of inadmissibility.
The Final Rule requires applicants for adjustment of status who are subject to the public charge ground of inadmissibility and certain applicants and petitioners seeking extension of stay and change of status to report certain information related to public benefits. Due to litigation-related delays in the Final Rule’s implementation, USCIS is applying this requirement as though it refers to Feb. 24, 2020, rather than Oct. 15, 2019. Please read all references to Oct. 15, 2019, as though they refer to Feb. 24, 2020.
USCIS will not consider, and applicants for adjustment of status who are subject to the public charge ground of inadmissibility do not need to report, the application for, certification or approval to receive, or receipt of certain previously excluded non-cash public benefits (such as SNAP, most forms of Medicaid, and public housing) before Feb. 24, 2020. Similarly, USCIS will not consider as a heavily weighted negative factor receipt of previously included public benefits (such as SSI and TANF) before Feb. 24, 2020, in a public charge inadmissibility determination.

I-944는 반드시 I-485와 함께 제출하셔야 합니다. 이민국에서 발행한 I-944의 instruction을 보면 특수한 이민카테고리 (refugees/asylees 또는 VAWA등)이 아니라면 employment-based immigration이라도 I-944는 반드시 제출해야 합니다.
Who Is Exempt from Filing Form I-944?
If you are exempt from the public charge ground of inadmissibility, you do not need to file Form I-944.
If you are applying for adjustment of status to that of a lawful permanent resident, you are exempt from the public charge
ground of inadmissibility if you are adjusting:
1. As a VAWA self-petitioner;
2. As a Special Immigrant Juvenile;
3. As a Certain Afghan or Iraqi national;
4. As an Asylee;
5. As a Refugee;
6. As a victim of qualifying criminal activity (U Nonimmigrant) under INA section 245(m);
7. Under any category other than INA section 245(m) but you are in valid U nonimmigrant status at the time you file
your application for adjustment of status. (This exemption only applies if, at the time of the adjudication of the Form
I-485, you are still in valid U nonimmigrant status. If, at the time of adjudication of the Form I-485, you are no longer
in valid U nonimmigrant status, you may be required to submit a Form I-944 and a Form I-864).

8. As a victim of human trafficking (T nonimmigrant) under section 245(l) of the INA;
9. Under any category other than INA section 245(l), but you either have a pending application for T nonimmigrant

19. As Nicaraguans and other Central Americans under section 203 of the Nicaraguan Adjustment and Central American
Relief Act (NACARA);
20. As an American Indian Born in Canada (INA section 289) or the Texas Band of Kickapoo Indians of the Kickapoo
Tribe of Oklahoma, Pub. L. 97-429 (Jan. 8, 1983); or
21. As a spouse, child, or parent of a deceased soldier under the National Defense Authorization Act (NDAA)

“If we receive a Form I-485 on or before Oct. 13, 2020, that does not have all required forms and evidence, we will request any missing forms and evidence.”
“After Oct. 13, 2020, we will reject your Form I-485 if you do not include the required forms and evidence with Form I-485 at the time of filing.” https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule이 문제는 논쟁거리가 아닙니다. 회사 스폰서를 통해 진행하는 영주권이라도 2020년 10월 13일 이후로는 반드시 I-944를 첨부해야 하므로 반드시 유의하시기 바랍니다.

답변 주신 분들 정말 감사합니다.
변호사에게 상황을 전달했고, I-944를 제출해야하는 것으로 마무리되었습니다.
그동안 변호사 바꾸고 싶은 순간이 수 백번이었으나 회사에서 고용한 분이라 저 혼자 애태우며 진행 중입니다.
영주권 준비하시는 모든 분들, 반드시 글자 하나 하나, 서류도 빠짐없이 꼼꼼히 준비하시기 바랍니다.
물론 신뢰를 바탕으로 변호사님께 맡기지만, 사람인지라 실수도 하고, 어이없는 상황이 생기곤 하네요.-
회사에서 선임한 변호사들 정말…저도 할말하않 입니다 ㅠ
