F 비자는 무조건 5년간 세법상 nonresident인가요?

    안녕하세요.
    세법상 RA, NRA가 좀 헤깔려서요.
    F Visa 소지자는 485 접수 및 EAD를 써서 485 pending 신분 등으로 변경되지 않으면 무조건 5년간 nonresident인지 궁금합니다.
    그렇다면 EAD를 안쓰고 F 비자를 485승인까지 유지한다면 계속 exempt 처리가 가능한지요?
    아니면 I140이나 485를 접수만 하면 체류일수 면제가 안되나요?

      485가 승인나기 전 까진 F 비자의 경우 5년간 난레지던트 입니다.

      답변 감사드립니다~ 8843 form으로보면 “did you apply for, or take other affirmative steps to apply for, lawful permanent resident statusin the United States or have an application pending to change your status to that of a lawful permanent resident of the United States? ” 이라는 문구가 있는데 I-140이나 I-485 접수했으면 Yes로 하고 사실을 쓰면 되는지요? 그리고 계속 exemlt되는건지 이 부분이 좀 헤깔려서요.

        140은 해당사항이 없는 것으로 알고있어요.

      영주권 승인 전 까지는 그냥 f1 이에요.

      or

      f1 으로 5년이상 미국내에 체류했으면 레지던트로 분류되구요. 5년 미만이면 무조건 논레지

      F1으로 4년 h1b로 2년차입니다. 이런경우는 RA인가요?
