안녕하세요 요번에 내년 1월에 140 접수 준비중입니다 (EB3)

1월문호가 filing 문호가 닫힘 따라 변호사님도 저도 당연히 동시접수는 포기하고 있었구요(변호사님은 강력하게 485접수가 안된다고하심) 하지만 그간 몇몇 분들의 댓글이 다시 1월에 485가 접수 가능하다고 그러셔서

변호사님한테 몇일전에 물어본 결과 다시 재차 485는 접수안된다고 하셨고 140만 넣고 승인받은후 문호열리길 기다리자고 하셨습니다.

근데 아직도 몇몇 댓글에 접수 가능하다고 하시는 분이 계시는데 뭐가 진실인지 궁금합니다. 어그로인가요?

저도 너무 궁금한 일인입니다.언제쯤 열린다고 얘기 들으신거 있나요?

접수 된다고 공식적으로 공지난건 하나도 없습니다. 몇몇 변호사들이 편지 받았다는거 같은데, 변호사한테만 USCIS가 편지를 보낸다는게 믿기는 힘들군요. 저도 이메일 등록되어있어서 공지뜰때마다 메일 받아보는데, 이 건은 들어본적 없습니다.

혹시 공지가 있을경우 알려주시면 감사하겠습니다.

밑에 있는 link를 보시면 Dates for Filing chart로는 문호가 닫혀 있어도 Final Action Dates chart로 문호가 개방이 되어 있거나 더 뒤에날짜로 문호가 열려 있다면 Final Action Dates chart를 사용하여 접수가 가능하다고 되어 있습니다. F2A 경우 이민국에서 Final Action Dates chart을 사용해도 된다고 언급이 되어 있습니다. 하지만 이민국에서 EB3 I-485도 그렇게 접수를 받아줄지에 관한 언급이 없고 원래 Dates for Filing chart를 사용하는 목적이 수요가 급증하는 3순위 영주권 신청을 조절하면서 이미 신청된 서류는 승인를 할 수 있도록 한것이니우선은 지켜보아야 할 것 같습니다.

말씀 하시는 내용은 General 한 이야기이고 applicants… “MAY” file using the Final Action Dates 인데 반해 이번달 공지는 For Employment-Based Preference Filings: You “MUST” use the Dates for Filing chart in the Department of State Visa Bulletin for January 2020 이므로 앞에 공지는 무시되는거 아닌가요?

말씀하신데로 과거의 사례에서, Final Action Date가 Current이고 Dates for Filing chart에 문호가 있는 경우 (F2A), 매달 공지에서 Final Action Date를 사용해도 된다는 내용을 따로 명시했었습니다. 즉, 따로 명시되어 있지 않으면 MUST항이 우선이 된다고 판단됩니다.

위쪽에서는

However, if a particular immigrant visa category is “current” on the Final Action Dates chart or the cutoff date on the Final Action Dates chart is later than the date on the Dates for Filing chart, applicants in that immigrant visa category may file using the Final Action Dates chart during that month..

라고 되어 있고 밑에쪽에는

For Employment-Based Preference Filings:
You must use the Dates for Filing chart in the Department of State Visa Bulletin for January 2020.

요 페이지에는 dates for filling만 나와 있어서 논란의 소지가 있는 것 같아요.

보통 논란의 소지가 있는 경우 uscis 심사관이 자의적으로 해석해서 거절 때릴 수 있고 설령 appeal 해서 승리한다고 해도 그전까지 고통을 받는 건 신청자 입장이라서요… 저는 보수적으로 1월엔 접수 안된다고 보는게 맞다고 봅니다.
