안녕하세요.

금일 회사 변호사가 보낸 이메일입니다. 제 priority date이 3/28/2019이고  visa-bulletin에 publish된 priority date가 3/1/2018이며, I-485를 파일링하려면 priority date가 current가 되거나 published priority date가 제 priority date보다 나중이 되어야 한다는 내용 같습니다. I-485 파일하려면 1년정도 기다려야 할 수도 있는 얘기로 들리는데, 지인 분들에 따르면 I-140 승인되면 보통 바로 I-485 파일했다고 하더라구요 (아주 최근 얘기는 아닌 것 같습니다). 이건 최근들어 EB-1 소요기간이 많이 길어졌다고 이해해야 하나요? 미처 파악하지 못했는데 사전 공부가 부족했나 봅니다.

Congratulations on the I-140 approval. As you can see from the approval notice, your priority date is 3/28/2019 and are you in the 1st employment based preference category. The next step is to wait for your priority date to become current and then file I-485 Adjustment of Status on your and your dependents' behalf. In order to do so, your priority date ( 3/28/2019) needs to be current in visa bulletin published by Department of State. Currently, priority date for South Korea-born individuals in the EB-1 category in May 2019 is 3/1/2018. We could only prepare and file I-485 Adjustment of Status on your and your dependents' behalf  when the priority date becomes "current" or becomes a date that is later than the published priority date.
