저희같은 상황에 계신분이 계실까봐 글을 올립니다.
같은 레벨의 학교로 트렌스러를 하고 학생 비자를
유지할때 day1 cpt를 신청해서 일하는 것에 대한
글입니다.

변호사는 문제가 없다고 했지만 학교와 다시 이야기를
하고 Sevis에 연락을 해보니 학교에 cpt가 커리큘럼으로
required되지 않은 상태에서는 하면 안된다는 이야기를 들었습니다.
남편 학교는 required가 아닌 경우니 cpt를 신청해서
일을하고 세금을 보고했으면 f1 visa violation에 걸리는 문제였어요.

변호사는 계속 전에 다른 분이 아무런 문제도 없이 영주권을 받았다고
걱정하지 말라고만 말했지 그분이 같은 레벨의 학교에 day1 cpt인지 여부도
확인하지 않은채 계속 괜찮다고 걱정하지 말라고만 했어요.

변호사 말을 듣고 그대로 했으면 분명 영주권 진행에 문제가 있었을 것입니다.

너무 화가나서 어떻게 해야할지를 모르겠습니다.

내일 거절된 485와 944를 보낼 예정이었는데 지금이라도 변호사를
바꿔야 할까요? 944도 구색에 맞게 잘 작성을 하고 보내는지도
의문이 드는 상황입니다.

어제는 괜찮다고 하고선 오늘 메일을 보내니 우리보고 학교에서 잘 알아보고 진행을 하라고 했다고 하네요.
어제 나눈 대화는 커리큘럼이나 자세한 사항이 아닌 괜찮을거라는 이야기는 했거든요.
그러고는 내일 485와 같이 944 접수하겠다는 사과도 없이 그런 단문의 답만 받아어요.
어찌해야할지..저희가 지금 아이가 21세가 되서 들어가야 하는 상황인데..너무 답답하고 속상해서
눈물만 납니다. 제가 만약 몰랐다면 그대로 cpt등록해서 일하고 세금보고 했을거예요.

변호사한테 일 다 맏기면 안되더라고요.. 저도 비슷한 일 당할 뻔 한 적 있는데 변호사는 나몰라라.. 전문가한테 맡기되 열심히 알아보고 확인 또 확인해야합니다

저보고 너무 이곳저곳에서 많은 정보를 얻으시는것 같다고 했어요. 왜 맨날 부정적으로 접근하냐구요.

원글님께 여쭙니다. ‘같은 레벨의 학교’ 라는 게 구체적으로 어떤 걸 말씀하시는 거죠? BA과정에서 BA과정으로, 또는 MASTER과정에서 MASTER과정으로, 이렇게 트랜스퍼하는 걸 의미하나요? 제 조카가 BA 마치고 OPT 했던 곳에서 140, 485 들어갔는데, 현재MBA 과정으로 Day1 CPT 하면서 학생비자 유지하고 있어요. MBA는 Master과정이니까 BA과정의 학교와 같은 레벨의 학교가 아닌 거죠?

윗님 저도 잘 몰라요. Higher level 이기는 한대 cpt라는것 자체가 두학기 정도 공부를 하고 주어지지 바로 주어지는것은 아니라는 말도 있어요. 하지만 학교에서 커리큘럼으로 cpt 가 있고 이게 i20에 cpt로 명시가 되어져야 합니다. 혹시 모르니 학교측과 이야기를 해보시고 sevis측과도 연락을 해보세요.
CPT is integral to your major and the experience must be part of your program of study.
When you enroll at the graduate level, your designated school official (DSO) may authorize CPT during your first semester if your program requires this type of experience. Ask your DSO for details.
Your DSO will provide you a new Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” that shows that the DSO has approved you for this employment.
You can work on CPT either full-time or part-time.
CPT requires a signed cooperative agreement or a letter from your employer.
If you have 12 months or more of full-time CPT, you are ineligible for OPT, but part-time CPT is fine and will not stop you from doing OPT.
프로그램에 있어야 하나봅니다. 첫학기부터 cpt를 쓰려면요.

규정에 다음과 같이 되어 있습니다.
원칙적으로 1학년 (2학기)를 마치고 OPT/CPT를 할 수 있는데, 대학원 과정에 CPT가 바로 필요한 (require) 경우에 처음부터 CPT를 할 수 있는 예외도 있습니다. 현실적으로는 이를 남용하는 경우가 있는데, 이민국에서 얼마나 문제를 삼는지는 모르겠습니다.

(10) Practical training. Practical training may be authorized to an F-1 student who has been lawfully enrolled on a full time basis, in a Service-approved college, university, conservatory, or seminary for one full academic year. … A student may be authorized 12 months of practical training, and becomes eligible for another 12 months of practical training when he or she changes to a higher educational level. Students in English language training programs are ineligible for practical training. An eligible student may request employment authorization for practical training in a position that is directly related to his or her major area of study. There are two types of practical training available:

(i) Curricular practical training. An F-1 student may be authorized by the DSO to participate in a curricular practical training program that is an integral part of an established curriculum. Curricular practical training is defined to be alternative work/study, internship, cooperative education, or any other type of required internship or practicum that is offered by sponsoring employers through cooperative agreements with the school. Students who have received one year or more of full time curricular practical training are ineligible for post-completion academic training. Exceptions to the one academic year requirement are provided for students enrolled in graduate studies that require immediate participation in curricular practical training. A request for authorization for curricular practical training must be made to the DSO. A student may begin curricular practical training only after receiving his or her Form I-20 with the DSO endorsement.
