영주권 승인 후에 바로 Layoff가 된 경우 Layoff 됐다는 증명서만
있으면 되는 것을 이곳을 통해서 알았었는데..
오늘 저희 변호사님을 찾아가서 여쭤 봤더니..
나중에 시민권을 신청할 때 문제가 있을 수 있다면서
적어도 3개월을 근무를 하여야 한다고 하는데..
정말로 앞으로 6~7년 이후에 시민권을 신청할 때에
영주권 취득후 바로 회사에서 Layoff 된 것이 문제가 될 까요?
참고로 저는 H1비자로 동일 회사에서 약 4년을 일했습니다.

상식적으로 생각해보면,

전혀 문제가 안되는 상황입니다.

US government gives green card because sponsor company guarentees full time job for you. If you get layoff right after receiving green card, government might think it is fraud since sponsor didn’t keep his promise for full time job. That is why your laywer tell you about 3 months employment. Being said that, it is gray area because nobody believes one person will work for one company forever after GC.

I bet 10 cents to no problem. If you left by your intention, it may cause a problem for a citizenship, since they supported your greencard for you to work even after GC approval. However, “they” fired you. You did not intend to leave. So, none’s comment is not fully correct. You should be fine.

In reality, US governemnt will not know unless sponsor company tells them. And i highly doubt that company will do that because it works against them. In that perpective, i think you will be fine. cheers
