계약당시 deposit 돈 반환에 대해

    6/10/2009에 빌더(Castle&Cook)와 258000불에 계약을 하고
    5000불을 Deposit했습니다.
    당시 집을 짓고 있었고, 8월 12일에 appraisal이 다녀가고
    오늘 레포트를 냈는데, 집가격이 $235000불로 평가를 했습니다.
    이에 빌더 세일즈맨이 appraisal 감정가가 incorrect하다며,
    제가 디포짓한 돈 5000불을 못받는다고 하더군요…

    Appraisal이 감정평가한 가격이 낮아서 론이 안나오는데,
    왜 제가 디포짓한 돈을 손해를 보아야 하는지요?

    처음에 계약당시 빌더(캐슬엔 쿳)에서 캘슬엔 쿳 모티지에서
    론을 받을 것을 요구해서(계약당시, 3% 클로징코스트 빌더부담
    하고 계약서에서도 있었음) 그곳에서 론을 받으려고 신청했으나,
    그곳에서는 취업비자, 영주권, 시민권 3부류만 론을 주고
    저같이 영주권진행중( Pending)에 대해서는 론을 안준다고 하더군요
    그러더니 외부에 론을 알아보라고 해서 론 승인을 받고,
    론 회사에서 어프레이절을 보내 집을 감정평가를 했는데,
    계약당시 집 가격보다 23000불 낮게 책정을 했다고, 잘못된 평가라며,
    디포짓한 돈을 못받는다고 메일을 보냈네요

    이런경우 어떻게 대응해야 하나요??/

    참고로 8/28일이 클로징 날인데….,

    We are working for you to get the appraisal in order.
    I will need until tomorrow until then we will have to wait and clear this incorrect appraisal.
    It is standard this far into escrow for the deposit to be kept.
    we made changes to the home specific for you. we would not do that for free.

    section #7 (a) and (b) of the contract.

    (a) Appraisal. Buyer acknowledges that Seller has no obligation to adjust the Total Purchase Price
    or otherwise compensate Buyer if the appraised value of the Property does not equal or exceed
    the Total Purchase Price. If the appraised value results in a reduction in the Loan amount,
    Buyer shall be obligated to pay the difference in cash at the Close of Escrow.

    (b) Failure to Obtain Financing.
    If Buyer fails to obtain Lender approval during the Loan Approval Period as a result of any of the following:

    (I) Buyer’s fault or misrepresentation;

    (ii) any voluntary act of Buyer undertaken for the purpose of preventing Lender approval;

    (iii) any request by Buyer that Lender not approve Buyer’s Loan;

    (iv) failure of Buyer to furnish all documents and information required by Lender within the time period as specified by Lender; or

    (v) any other act of Buyer which prevents Lender Approval;

    then, and in any such event, Buyer shall be in default hereunder

    After speaking to Castle & Cooke it is in everyone’s best interest to work on the appraisal.
    for you, you would lose all deposits. For everyone else that has worked so hard on this deal,
    we will have lost priceless time and efforts. the appraiser is way off.
    I have an appraisal higher than yours, on the house 2 homes over from you,
    the Spanish style 1668sqft came in over your appraisal.
    we are currently working on new fresh comps for your appraisal to be reviewed.
    once I have those comparables I will give to both of you to forward to Appraiser.

      론이 승인이 안되면 디파짓을 다 돌려 받을수 있는걸로 알고 있는데요.

      신축건물에 대해서는 원글에서 말씀하신 규정이 있습니다. section #7 (a) and (b) of the contract의 내용인데 잘 읽어보시면 이해가 될 겁니다. 디포짓을 돌려받기가 힘들어 보입니다.

      차선책으로 다른 론을 알아보시 것도 방법입니다.
