The general rule is that an employer cannot force female employees to wear skirts. That legal prohibition comes from Government Code section 12947.5 that says in subsection (a) that "it shall be an unlawful employment practice for an employer to refuse to permit an employee to wear pants on account of the sex of the employee." However, there are statutory exceptions to this general rule. Subsection (b) provides that "nothing in this section shall prohibit an employer from requiring employees in a particular occupation to wear a uniform" and subsection (c) provides that "nothing in this section shall prohibit an employer from requiring an employee to wear a costume while that employee is portraying a specific character or dramatic role. These latter two exceptions have been used by restaurants across the state to require wait staff to wear particular clothing and call it a uniform or a costume. Your employer may well claim that since the dress code only applies on game days, you are required to wear a cheerleader costume to keep the restaurant theme cohesive and attractive. The issue is not as easy as simply saying a California employer cannot deny you the right to wear pants. If you and your female co-workers want to challenge this dress code, it would be prudent to locate and consult with an experienced employment law attorney as soon as possible to explore your facts and determine your options. I would suggest you look either on this site in the Find a Lawyer section, or go to www.cela.org, the home page for the California Employment Lawyers Association, an organization whose members are dedicated to the representation of employees against their employers. Most employment attorneys who practice this area of law work on a contingency basis, meaning you can hire an attorney without paying any money until the matter results in a positive outcome for you. Many advance all the costs of the litigation as well. Do not let fear of fees and costs keep you from finding a good attorney. Good luck to you.
