F비자처럼 dual intent가 아닌 비자일때 리스크가 있는 스텝은 status change를 하게 되는 485를 낼때에요. 140 자체는 이민 의도가 성립 안되는 걸로 알고있어요. 대신 485 내고 나면 콤보카드 나올때까지는 해외에 못 나가고 꼼짝 않고 있어야해요. 485 내고 콤보카드 기다리는 동안에 비자가 만료라도 되면 문제가 될수도 있고요.

Filing an I-140, immigrant petition, and/or and I-485, application for an adjustment of status, shows specific “immigrant intent.” These actions show specific immigrant intent and make it very hard if not impossible to apply F-1 visa, make an entry into the US with F-1 visa, or to much less extent, change into F-1 status in the future from another status . Please note that the law does not treat the filing of I-140 and I-485 petitions differently with regard to finding “immigrant intent.”

하지만, I-140을 신청한경우는 이민 이민 의도가 노출 된 경우 이므로, 나중에 이민의도를 인정 안하는 F,J,M 등의 비자는 거절될 확률이 높고, Dual Intent 를 인정 하는 H-1B, L-1, O-1등은, I-140 신청 기록이 있다고해서, 신청시 불이익은 없다.
