9 FAM 402.13-10(B) Applicability of 214(b)
a. An applicant for an O-1 visa does not have to have a residence abroad which he or she does not intend to abandon; however, aside from the conditions set forth in 9 FAM 402.13-5(C) above. There must be a temporary intent to remain on the part of the O-1 visa holder. (See 8 CFR 214.2(o)(13).) Thus, “dual intent” is permissible for O-1 visa holders.
