    안녕하세요.

    I-539 연장하는 상황에서 문제가 발생하여 문의좀 드립니다.
    현재 저와 배우자의 비자가 만료(?)되어 배우자의 회사 변호사를 통해서 연장을 했는데.
    문제는 변호사가 배우자의 비자만을 연장하고 제꺼는 연장을 하지 않았습니다.
    부랴부랴 제꺼만 다시 연장 신청을 신청하였는데 initial review중으로 3주 가까이 걸려 있습니다.
    따라서 현재 비자는 만료된지 이제 한달이 되어가고 있구요.
    현 상황에서 변호사를 선임하여 따로 처리하는게 좋은지, 아니면 혹 green card를 진행 중인데 그거에 문제가 없게하기 위해서 출국을 하는게 좋은지 모르겠습니다.
    배우자의 회사 변호사는 자신의 실수이기 때문에 긍정적인 답변만을 내놓고 말을 아끼고 있는 상황이라서 답답해서 문의 드립니다.
    조언 좀 부탁 드립니다.

      One simple principle will be applied to all COS/extension cases:

      You can change your non-immigrant status to another or request for an extension of the stay within the current status, ONLY when you have a valid non-immigrant status.

      혹 green card를 진행 중인데 그거에 문제가 >>> it will depend on what stage you are at on your green card process. If you have already filed your I-485, you should be fine staying without any non-immigrant status (however, this will be risky just in case your I-485 gets denied/rejected). If you haven’t, above simple rule will also be applied. You are not able to file the I-485 without any valid non-immigrant status…
