H1B 비자 연장을 하면서

    영주권이 아직 나오지 않았기때문에 또다시 H-1B 비자를 연장해야 하는데요. 이번에 Apply를 하려하니까 Export Control Laws에 의해서 현재 Network Administrator가 하는 일에 대한 제한을 받게 됐는데요. 

    저희 회사가 Government Contractor라 정부에 관련된 일들이 있긴 하지만 저는 직접적으로 정부에 관련된 일을 하지 않음에도 불구하고 서버를 관리하고 유저들의 컴퓨터를 고치고 관리하는데 이런것들을 영주권이 나오기전까지 당분간 할 수 없다면서 admin 권한을 뺏겼습니다. 그리고는 지금 할 수 있는건 컨설팅정도로밖에 할 수 없게 됐습니다. 그러다보니 제가 할일이 없어졌고 나중에 리뷰할때도 힘들어질테고, 다른곳이나 다른 일을 하게 될 확률도 높아졌습니다. 
    아래에 적힌 내용을 보고 이야기를 하던데요.
    여기서 이야기하는 license만 있으면 가능한건가요?
    아니면 뭘 어떻게해야 다시 예전과 같은 일을 할 수 있을까요?
    네트워크 관리자가 서버와 컴퓨터를 만질 수 없다면 할 수 있는 일이 거의 없죠.
    자세한 설명좀 부탁합니다. 
    회사쪽에서 뭔가 잘못 이해했다면 다시 수정하고 예전처럼 일을 할 수 있게 말이죠.

    IMPORTANT INFORMATION:  (Form I-129, Page 5, Part 6)

     

    U.S. Citizenship and Immigration Services (“USCIS”) is now requiring employers petitioning to sponsor individuals in H-1B, H-1B1, L-1 or O-1A status to certify that the company is complying with export control laws with regard to the release of technology or technical data regarding the development, production, or use of an item regulated by U.S. export control laws to that individual.

     

    The U.S. Department of State’s International Traffic in Arms Regulations (ITAR) and/or the U.S. Department of Commerce’s Export Administration Regulations (EAR) prohibit the release of certain information to a “foreign person” (such as a person with H-1B, H-1B1, L-1, or O-1A status) without an appropriate export license, and any such release “is deemed to be an export to the home country or countries of the foreign national.”  This is known as a “deemed export.”

     

    A petitioner filing USCIS Form I-129, Petition for Nonimmigrant Worker, for  H-1B, H-1B1, L-1, or O-1A visa statuses must certify that it has determined whether the individual needs a license and must answer the following:

    Check Box 1 or Box 2 as appropriate:

    With respect to the technology or technical data the petitioner will release or otherwise provide access to the beneficiary, the petitioner certifies that it has reviewed the Export Administration Regulations (EAR) and the International Traffic in Arms Regulations (ITAR) and has determined that:

    1. A license is not required from either the U.S. Department of Commerce or the U.S. Department of State to release such technology or technical data to the foreign person; or

    2. A license is required from the U.S. Department of Commerce and/or the U.S. Department of State to release such technology or technical data to the beneficiary and the petitioner will prevent access to the controlled technology or technical data by the beneficiary until and unless the petitioner has received the required license or other authorization to release it to the beneficiary
