2010년 8월 NEBRASKA SERVICE CENTER에 EB2 접수했는데요, 9월 I-140, 10월 I-765, 11월 I-131이 차례로 승인 되었고 11중순 핑거 했는데요, 2011년 1월, TEXAS SERVICE CENTER에서 편지가 왔는데요, 너 파일했냐고 물어보더라고요.

After reviewing our systems, We have not found any evidence that you have filed an application or petition with us. However, if you have evidence that your application or petition and fee were accepted. Please submit a new application or petition with this office with proof of the prior payment with a copy of the original application or petition.

 

그래서 변호사에게 문의하니 NEBRASKA에서 TEXAS로 case가 이전된거 같고 아직 서류가 안넘어 간거 같다고 말씀합니다. 그런데 USCIS online에서 case status 체크 해보면 여전히 Acceptance이고요, 아래와같이 NEBRASKA 에 여전히 case가 처리되고 있다고 나옵니다.

On August 13, 2010, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Please follow any instructions on this notice. Your case is being processed at our NEBRASKA SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you.

 

그래서 NEBRASKA 문의 해봤더니 지난 4월 아래처럼 응답이 왔습니다.

Based on your request We researched the status of this case. We are actively processing this case. However, We have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.

 

네브라스카에 있는건지, 아니면 텍사스에 있는건지, 485 case가 어디에 있는지도 헷갈리고요, 그리고 USCIS online에서 status 체크해보면 여전히 Acceptance이고요, initial review도 안하고 있다고 나오는데 뭘 더 리뷰를 해야 한다고 하는건지 모르겠습니다. 변호사도 왜 그런지 잘 모르겠다고 하면서 뭐 범죄 기록 있냐고 물어보는데 참 대답하기도 기가 찹니다. 올해 2월이면 나온다고 해서 작년말에 H1B 완료되었을때 버렸는데,10월 7일이면 작년에 받은 work permit(EAD)도 끝나서 이거 연장해야 하는 기가막힌 상황이 되어 버렸습니다. 이 상황에서 뭘 해야 되는지도 모르겠네요. 지금 기냥 멀뚱이 있는데요, 혹시 이런 비슷한 경우 아시면 정말 도움 말씀 청합니다.
